What are the key skills and qualifications needed to thrive as a Claims Counsel, and why are they important?

To excel as a Claims Counsel, you generally need a Juris Doctor (JD) degree, a valid law license, and expertise in insurance law and claims management. Familiarity with legal research platforms like Westlaw or LexisNexis and claims management systems is also important. Strong negotiation, analytical thinking, and communication skills help you resolve disputes and collaborate effectively with various stakeholders. These competencies ensure accurate legal evaluations, minimize risk, and support successful claim resolutions for clients or insurers.

How does a Claims Counsel typically collaborate with other departments during the claims process?

Claims Counsel frequently works closely with claims adjusters, underwriters, and risk management teams to assess liability, evaluate policy coverage, and develop resolution strategies. Effective collaboration is essential for gathering all relevant facts, ensuring compliance with legal and regulatory standards, and providing informed recommendations to minimize risk. In many organizations, Claims Counsel also participates in cross-functional meetings and communicates with external stakeholders, such as outside counsel or clients, fostering a team-oriented approach to resolving complex claims.

What are Claims Counsel?

As claims counsel, your duties involve contract negotiation and reviews, along with the investigation, analysis, and filing of insurance claims on behalf of the company or employees. In the event that an insurer refuses to pay a claim, you take the insurance company to court and represent your company through litigation. You may also collaborate with colleagues in the finance and risk management departments, offering legal analysis of company policies as well as insurance products the company is seeking to purchase.
