Job description

Duties Description POSITION DESCRIPTION:
The Human Resources Specialist 1 LR will be part of the Labor Relations Unit in OHRM. Under the supervision of a Human Resources Specialist 2 LR, this Human Resources Specialist 1 LR will handle employee grievances, disciplinary matters, administrative investigations, and other employee relations issues, as well as provide contract interpretation, and personnel administration.
PRIMARY DUTIES AND RESPONSIBILITIES Include, but not limited to:
Grievances:
• Receive and review grievances and schedule related hearings. The Human Resources Specialist 1 LR must read, understand, and interpret the contracts for 5 different negotiating units, as well as knowing the procedures to follow in matters related to employees designated as Management/Confidential.
• Serve as hearing officer for the first step of the grievances.
• Research issues that are the subject of the grievance. This may involve contacting managers to get additional information.
• Write grievance decisions and letters of determinations.
• Process appeals and attend Step 2 hearings, as required.
Disciplinary actions:
• Provide guidance to department managers and supervisors on actions that can be taken in response to inappropriate employee actions.
• Track the status of investigations associated with the discipline, when someone else is conducting it. Ensure that formal counseling is completed by supervisors.
• Write charges for Notice of Discipline (NODs) for some administrative investigations.
• Prepare the paperwork for disciplinary NODs and serve them. This includes arranging for employees and the Union representative to be available.
• Help maintain the computerized tracking system for every interrogation that is conducted.
• Complete Time and Attendance NODs, including the writing of the charges, preparation of the actual NOD; attend Time and Attendance Hearings as the DDSO representative.
Administrative Investigations:
• Develop a plan for conducting the investigation.
• Obtain information about the incident.
• Interview witnesses. This includes developing questions to ask.
• Review and (remove) pertinent documents and policies.
• Interrogate the person(s) being investigated.
• Write a report that includes findings, conclusions, and recommendations.
Other:
• Serve as a consultant to program areas and the Unions.
• Serve as liaison with Central Office Employee Relations staff.
• Attend Arbitrations to support the DDSO by providing clarification to and assisting the State's Representative.
• Assist in the preparation of witnesses for Arbitrations.
• Review formal counseling memo written by supervisors to ensure they are accurate and complete and follow DDSO protocols.
• As assigned, schedule Labor/Management meetings; work in conjunction with Union representatives to develop the agenda; facilitate the meetings; review and finalize the minutes. Ensure that actions items are completed.
• Attend interrogations done by Central Office and by DDSO Investigators to ensure the integrity of the interrogation by recording the interrogation, advising employees of the need for confidentiality; advising employees of the process; and asking relevant follow-up questions.
• Train supervisors on Time and Attendance Guidelines and on the process for Time and Attendance NODs.
• Unemployment insurance matters:
• Respond to requests for information from claims examiners.
• Attend Appeal Hearings before an administrative law judge, as needed.
• Review documents received from UI to ensure their accuracy, so that the DDSO's account is not improperly charged.

Minimum Qualifications Competitive:
Candidates must be reachable for appointment on the Current Civil Service Eligible List, Professional Careers Opportunity (PCO) or Public Administration Traineeship Transition (PATT). Appointment may be made at the traineeship level.

Four years of labor relations experience, which includes directing the implementation of collective bargaining agreements; representing a company in negotiations; and directing or participating in labor management committees; providing expert advice and assistance to program managers and supervisors in disciplinary matters; and reviewing and evaluating policies and procedures.
Human Resources Specialist Trainee 2 Labor Relations, NS (equivalent to SG-16):
Five years of labor relations experience, which includes directing the implementation of collective bargaining agreements; representing a company in negotiations; and directing or participating in labor management committees; providing expert advice and assistance to program managers and supervisors in disciplinary matters; and reviewing and evaluating policies and procedures.
Human Resources Specialist 1 Labor Relations, SG-18:
Six years of labor relations experience, which includes directing the implementation of collective bargaining agreements; representing a company in negotiations; and directing or participating in labor management committees; providing expert advice and assistance to program managers and supervisors in disciplinary matters; and reviewing and evaluating policies and procedures.
Substitution:
An associate degree may substitute for two years of experience; a bachelor's degree may substitute for four years of experience; a master's degree may substitute for five years of experience; and a doctorate may substitute for six years of experience.
Transfer:
Candidates must have one year of permanent competitive, non-competitive or 55-b/c status in the posted title and be eligible for lateral transfer; OR be eligible to transfer via Section 70.1, 70.4, or 52.6 of Civil Service Law. The transfer cannot be a second consecutive transfer resulting in an advancement of more than two salary grades.

55 B/C Qualifications:
• Possess the minimum qualifications for this title as established by the Department of Civil Service and listed on the most recent exam announcement.

Additional Comments This title is part of the New York Hiring for Emergency Limited Placement Statewide Program (NY HELPS). HELPS Program titles may be filled via a non-competitive appointment. This means that you do not need to take an exam to qualify, but you do need to meet the minimum qualifications of the title.
At a future date (within one year of permanent appointment), employees hired under NY HELPS are expected to have their permanent non-competitive employment status converted to permanent competitive status. You will not have to take an exam to gain permanent competitive status.
• Appointments may also be made at the Human Resources Specialist Trainee 1 LR levels. Candidates hired at the entry-level title (Human Resources Specialist Trainee 1 LR) may be advanced to the full-performance level (Human Resources Specialist 1 LR) following satisfactory completion of two-years of service.
