Description
DEFINITION: Perform professional judicial duties in interpreting and applying the local, state and federal laws and manage the activities of the operating division of the City of Marshall Municipal Court.
Examples of Duties
ESSENTIAL AND RELATED FUNCTION STATEMENTS:
Essential and other important responsibilities and duties may include, but are not limited to, the following:
  • Presides over court proceedings within the jurisdictional limits of the City of Marshall and performs the full duties of the office as defined by law and city ordinance violations.
  • Preside over court dockets, which include, initial appearance/arraignment, pre-trial conferences, bench and jury trials, and other judicial proceedings.
  • Performs technical, legal, and administrative duties in managing the court and official records.
  • Supports court activities with Municipal Court Administrator, City Prosecutor, and other city departments.
  • Presides over administrative hearings, court hearings, jury trials, and bench trials; processes and adjudicates criminal and civil cases in accordance with state and federal statutes, City ordinances, and court rules and procedures.
  • Preside over a variety of hearing including criminal misdemeanor and traffic arraignments, driving and curfew arraignments, criminal non-jury trials, and pre-trial conferences.
  • Review requests for continuances; grant or deny requests.
  • Serve order to persons held in custody.
  • Review search warrants; sign or reject warrants; confirm warrant recalls.
  • Review and sign complaints, summons, subpoenas, arrest warrants and adult diversion forms.
  • Review and sign seized property releases.
  • Oversee the assignment and management of the work of all Court employees.
  • Evaluate and analyze the statistical data on a continuing basis concerning the management of courtroom case flow and oversee periodic reports based on that data.
  • Direct the development and installation of procedural, technical and operational improvements.
  • Determines the long-range plan for the Court.
  • Correspond with non-local defendants for dispositions of cases by mail when appropriate.
  • Act as unofficial ombudsman for public questions regarding drivers' license reinstatement, vehicle registration, removal of convictions and referral to appropriate agencies.
  • Perform legal search.
  • Demonstrate continuous effort to improve operations, decrease turnaround times, streamline work processes and work cooperatively and jointly to provide quality seamless customer service.
  • Be dependable and meet acceptable attendance requirements at all times.
  • Follow all applicable safety rules and regulations.
  • Protect confidential information by preventing unauthorized release, both verbal and/or written.
  • Assist in department operations and perform other related duties as assigned.
  • Perform additional duties as apparent and/or assigned

Typical Qualifications
MINIMUM QUALIFICATIONS:
Sufficient education, training and/or work experience to demonstrate possession of the following knowledge, skills, and abilities which would typically be acquired through:
  • Juris Doctorate Degree is required; a minimum of two year's practice of law in the state of Texas is required.
  • Must demonstrate effective communication skills and have a public service attitude
  • Must have an understanding of State of Texas criminal and civil statutes, rules, administrative orders, policies and procedures, and applicable Federal rules and regulations.
  • Texas judicial procedures and rules of evidence.
  • A Texas State Driver's License is required.
  • Must be a member of the Texas State Bar Association, licensed to practice law in the state of Texas and remain active with all Texas Bar annual requirements.
