Main Objectives

The pre-litigation attorney is responsible for building value in the cases on his/her docket.

  1. Client Contact. Timely answer and return all client calls.
  2. Case Development. Timely identify value builders and direct teams on appropriate actions.
  3. File Documentation. Immediately document all available data in the case file. If it’s not in the file, it didn’t happen.

The pre-litigation attorney should review files and direct the assigned team members to take appropriate actions on each file. Pre-litigation attorneys will also negotiate settlement of cases assigned to them and oversee negotiations on their team.


Main Responsibilities

  • Serve as Attorney mentor to firm team members
  • Review files assigned to CSRs and Negotiator at specified touchpoints, give direction on issues such as: liability, treatment, litigation referrals, evidence gathering, etc.
  • Review files for value building factors and direct accordingly
  • Review negotiations files for settlement ranges and approve settlements by Negotiator
  • Review demands for all cases on the team. Assign to Negotiator as appropriate
  • Negotiate settlement of assigned cases, refer to litigation as appropriate
  • Review offers/settlement with clients
  • Review Disbursal Awards
  • Calculate and negotiate lien reductions on settled cases
  • Take escalation calls from clients assigned to team
  • Maintain average negotiations cycle time of sixty (60) days or less
  • Settle minimum of thirty (30) cases each month
  • Obtain minimum of $285,000 in attorney’s fees each month, averaging $9,500 per settlement

  • Reports to Chief Operating Officer
  • Direct Supervisor of Negotiator
  • Interview, counsel, performance review with negotiator
  • Advise and direct CSMs, CSRs and Negotiators on cases
