Rendering "in-house counsel" advice to program managers; preparing pleadings; planning litigation strategy; drafting legislation, rules, and regulations; analyzing legal opinions, briefs and other material; performing legal research and analysis; drafting or reviewing contracts; preparing opinions and memoranda of law; or appearing at administrative tribunals or courts.
Representing the Retirement System at administrative hearings. Review and provide responses to subpoenas, records requests, powers of attorney, trust documents, estate papers, and guardianship orders submitted to the Retirement System. Review and prepare legal documents, supporting documentation, legislation, and/or regulations. Review settlement agreements and collective bargaining agreements to advise on the pensionability of salary and service.

  • Assistant Attorney 2 (Grade 20): Admission to NYS Bar

  • Senior Attorney (Grade 25): 12 months as an Assistant Attorney 3, or Admission to the NYS Bar and 24 months of subsequent satisfactory legal experience

Transfer Options:
70.1 Transfer:
For a 70.1 transfer to the Senior Attorney, SG-25, you must have one year of permanent competitive service in an approved 70.1 title allocated to a salary grade 23 or above.
52.6 Transfer:
For a 52.6 transfer to the Senior Attorney, SG-25, you must have one year of permanent competitive service in an approved 52.6 title allocated to a salary grade 23 or above and must have 12 months as an Assistant Attorney 3 OR admission to the New York State Bar AND 24 months of subsequent satisfactory legal experience.

Appointments via transfer must not result in a second, consecutive transfer with an advancement of more than two S-grades or one M-grade.
Preferred Qualifications/Knowledge, Skills and Abilities:
  • Attorney admitted to practice in New York, or eligible for the NYS Bar Exam
  • Excellent written and oral communication skills
  • Excellent legal research skills and ability to analyze legal issues
  • Experience in conducting administrative hearings
  • Trust and Estates, Guardianship and Powers of Attorney experience
  • Knowledge of or experience with administrative law
  • Familiarity with New York State Retirement System

Traineeship Salary Information:
The position may be filled at the Assistant Attorney 1 equated to SG-18 ($66,951), Assistant Attorney 2 equated to SG-20 ($74,193), or Assistant Attorney 3 SG-22 ($82,326) based on the candidate's education, experience, and previous state service. Salary is nonnegotiable.
Candidates hired at the trainee level will be advanced to the full performance Senior Attorney SG-25 ($96,336) following successful completion of the traineeship.
