State Personnel System Opportunity
Applicants accepted only from employees currently employed in a State Personnel System position. Applicants will not be accepted from those employed outside of the State Personnel System.
This position is responsible for managing, planning, and directing highly varied and complex human resource management and labor relation functions. The incumbent assists and advises management in taking disciplinary actions, including suspensions and dismissals; investigates collective bargaining grievances involving discipline, attends union grievance meetings, and prepares responses; analyzes legislation impacting labor and employee relations; and independently works on special projects involving discipline, collective bargaining, and other labor or employee relations issues.
Consults with and provides technical assistance to managers and supervisors on disciplinary problems, particularly those of more serious nature (suspensions and dismissals). This includes advising management of whether discipline should be taken and, if so, the level of discipline to be applied; ensuring that the proposed discipline action is in accordance with the Personnel Rules, applicable union contract, agency policy and procedure, and other applicable laws and regulations, including FMLA, FSWP, PWFA, and ADA; ensuring that the action to be taken is consistent with discipline applied in similar situations; researching issues related to the proposed action; ensuring that time limits are met; preparing or assisting in the preparation of the predetermination letter; providing assistance on predetermination conference procedures; and assisting as necessary with any subsequent PERC appeal or collective bargaining grievance, through arbitration.
Independently handles collective bargaining / career service grievances involving discipline and alleged contract violations. This includes gathering and analyzing relevant information; investigating the grievance; researching previous discipline and responses in similar situations; conducting meetings with union and / or management representatives; ensuring compliance by the union and agency with time limits; and drafting the response for managements signature. If a collective bargaining grievance is appealed, provides documents and information requested by the Department of Management Services; and verifies that the grievance was timely filed to the next step. If the grievance is appealed to arbitration, coordinates with the appropriate attorney (at DMS or within the department); provides documents and information requested; and assists with the arbitration to the extent necessary.
Ensures all disciplinary actions are entered into the HR System of record. Researches and analyzes PERC and arbitration decisions and updates managers and supervisors on the status of employee and labor relations issues. Assist with PERC appeals, as required.
Provides consultation and technical assistance to offices in handling labor relations problems with respect to day-to-day contract administration, interpretation of the Personnel Rules, and other human resource issues. Responds to requests for information from other state agencies and the public.
Participates in management reviews. Assists in the analysis of review data and in the preparation of final recommendations and reports. Analyzes proposed legislation that affects the department from an operational, management or fiscal standpoint.
Participates on behalf of the agency at consultation meetings and union contract negotiation sessions. Assists with the assessment of proposed bargaining issues to determine the operational, management or fiscal impact on the department.
Provides assistance on special projects involving labor relations, discipline, performance, etc.
Has primary responsibility for issues related to the Family and Medical Leave Act, Family Supportive Work Program, Paid Parental Leave, and Americans with Disability Act accommodations. This includes developing and being primarily responsible for training in this area.
Provides the labor relations portion of the personnel procedures training. This includes discipline, grievances, performance evaluations, FMLA/FSWP, ADA, and drug-free workplace. Provides specialized training to groups of supervisors and managers on request.
Process all Reemployment Assistance Claims for offices serviced.
Performs other related duties as required. (Such as mediation, compulsory disability, etc.
