Legal at Brex

The Legal team helps the company grow responsibly, advocating for Brex and for the thousands of growing businesses we serve. We provide strategic advice and guidance to all Brex teams, protect Brex, advise on risk, and represent the company externally, negotiating with partners and interacting with regulators. Reimagining the financial system in a highly regulated environment requires creativity and resourcefulness, and we welcome the challenge.

What you'll do

You will help us build, globally scale, and continuously improve Brex's spend management software products, including budgets, spend policies, approvals, and audit and controls from the earliest stages of ideation through launch-translating complex regulatory, card network, and bank partner requirements into practical product decisions and helping teams move fast without compromising on compliance. You'll help advise on the regulatory and commercial issues that arise across software and fintech products-data privacy, contracting, intellectual property, AI and automation, and consumer- and commercial-protection requirements-providing strategic advice on risk and ambiguity as we design and ship new features. You'll also collaborate closely with cross-functional partners (including privacy, security, compliance, marketing, sales, and partnerships) to find creative solutions to business problems. You know how to break a project down into first principles and see it from concept to release, and you understand when to solve a problem in-house.

Where you'll work

This role will be based in our Seattle office. We are a hybrid environment that combines the energy and connections of being in the office with the benefits and flexibility of working from home. We currently require a minimum of three coordinated days in the office per week, Monday, Wednesday and Thursday. As a perk, we also have up to four weeks per year of fully remote work!

Responsibilities

  • Serve as the embedded legal partner to engineering, product, and design teams building spend management software-budgets, policies, approvals, and audit and controls-advising in real time as features are designed and built
  • Provide pragmatic, actionable advice on requirements and best practices for existing and new spend management software features
  • Advise on the regulatory and commercial implications of product architecture, data flows, automation and AI features, integrations, and feature design, helping teams make sound build-versus-defer decisions
  • Advise a variety of cross-functional partners on critical credit, lending, and card network regulatory questions
  • Advise a variety of cross-functional partners on critical software, data privacy, and product regulatory questions
  • Advise on product and marketing collateral, customer communications, and disclosures for spend management software products
  • Draft, update, and maintain customer agreements, terms, disclosures, and feature-level terms for spend management software
  • Support data handling, integration, and partner arrangements as they relate to product launches

Requirements 

  • 4+ years working experience in a combination of law firms and technology or fintech companies, ideally advising on credit card, lending, and commercial matters for regulated financial or technology products
  • Familiarity with federal, state, and international credit, lending, and card laws and regulations, including TILA/Regulation Z, ECOA/Regulation B, UDAP/UDAAP, card network rules (Visa, Mastercard, Amex, Discover), and required disclosures
  • Excellent written and verbal communication skills, both internal (memos, guides, presentations) and external (customer agreements, terms, disclosures, customer communications)
  • Ownership mentality and comfort working on complex matters that require sound judgment
  • Entrepreneurial mindset and ability to work in a fast-paced environment
  • Law degree and admitted to practice in at least one jurisdiction
  • Willingness to be a team player who pitches in to help out on other products and topics; one of our key tenets is "One Brex"

Bonus Points

  • Prior in-house counsel experience at a scaling fintech, payments, or software company
  • Experience advising on AI and automation features
  • Experience negotiating with or managing bank partner and card network relationships
  • Experience interacting directly with regulatory agencies


Compensation

The expected salary range for this role is $220,000-$270,000 USD.  However, the starting base pay will depend on a number of factors, including the candidate's location, skills, experience, market demands, and internal pay parity. Depending on the position offered, equity and other forms of compensation may be provided as part of a total compensation package.
