The City of Anaheim seeks a dynamic and dedicated Deputy City Attorney I for the City Attorney's Office- Criminal Prosecution section to perform a wide variety of professional legal duties ranging in difficulty from moderate to highly complex cases. The Deputy City Attorney I will provide staff assistance to a Senior and/or Assistant City Attorney with legal activities involving criminal law, municipal codes and ordinances, and representing the People in criminal matters.

This is the entry level class in the series. Attorney to perform legal tasks to include the filing of criminal cases, motions, and jury trials ranging from less difficult to complex matters.

Employees in all Deputy City Attorney classes perform professional legal duties of similar type and character. Work of Deputy City Attorneys at each of these levels are distinguished by increasing proficiency and skill in independently handling legal issues, matters, and cases of increasing complexity and risk to the City with experienced legal judgment and acumen.
The following functions are typical for this classification. Incumbents may not perform all of the listed functions and/or may be required to perform additional or different functions from those set forth below to address business needs and changing business practices.
Provide effective prosecution of misdemeanors and infractions occurring within the City; review and file cases; subpoena witnesses; prepare discovery responses; negotiate cases with opposing attorneys; represent the City in arraignments, pre-trials, jury trials, and appellate matters.
Direct follow-up investigations by Police Department personnel in misdemeanor cases.
May evaluate constitutional compliance of Police Department investigations.
May attend City meetings related to the investigation of municipal code related violations; negotiate municipal code related violations with property/business owners in order to resolve the violations prior to criminal case filings.
Participate in City-wide meetings regarding issues confronting the enforcement of state and municipal laws and codes; attend meetings of various trade organizations related to issues confronting municipal code, state, local laws and regulations.
Assist in preparing reviews of inspections and search warrants.
Perform related duties as required.

Experience and Education: Some responsible experience in the field of municipal or criminal law is desirable.
License/Certification Required: Membership in the State Bar of California and license to practice in the federal courts. Possession of an appropriate, valid driver's license.

Knowledge:

  • Knowledge of legal principles, practices, and procedures related to criminal law, judicial procedures and rules of evidence; methods and techniques of legal research, case analysis, and report preparation.
  • Knowledge of standard legal references and their content; legal precedents and court decisions affecting criminal law; statutes and codes applicable to proceedings relating to criminal law, which may include constitutional law; and pertinent federal, state, and local laws, codes, and regulations.
  • Knowledge of office procedures, methods, and equipment including computers and applicable software applications such as word processing and databases.

Ability:
  • Ability to perform a variety of legal work in criminal law practice with varying degrees of complexity and difficulty; develop, prepare, and present cases in court, research and compile data on a variety of legal cases; and conduct research on legal problems.
  • Ability to prepare clear and concise legal documents and briefs; properly interpret and make decisions in accordance with laws, regulations, and policies; present statements of law, fact and argument clearly and logically; and provide legal advice and consultation to City law enforcement.
  • Ability to plan and organize work to meet changing priorities and deadlines; plan, prioritize, and execute time lines without supervision; meet critical deadlines while working with frequent interruptions; exercise good judgment and maintain confidentiality regarding critical and sensitive information, records, and reports; communicate clearly and concisely, both orally and in writing; and establish and maintain effective working relationships with those contacted in the course of work.
  • Strong desire for extensive jury trial work is highly desirable.
