Title: Commercial Litigation Associate

Location: Birmingham, AL 

Salary: $150k-$220k/yr
Position Overview
We are seeking a skilled Commercial Litigation Associate to join our litigation team focusing on disputes in the financial services and lending sectors. The successful candidate will manage complex commercial litigation matters from intake through trial and appeal, providing strategic, client-focused representation in matters including loan enforcement, bankruptcy-related litigation, contract disputes, and other commercial controversies. This role demands strong courtroom and deposition experience, excellent pleading and motion practice skills, and the ability to work collaboratively with partners and clients to achieve favorable outcomes.
Key Responsibilities

  • Manage a docket of commercial litigation matters in the financial services and lending industries, overseeing cases from complaint through resolution, trial or appeal.
  • Prepare and draft pleadings, motions, briefs, settlement agreements, and other substantive court filings with attention to strategy and procedural compliance.
  • Conduct factual and legal research, analyze case law and statutory issues, and develop winning litigation strategies tailored to client objectives.
  • Take and defend depositions, prepare witnesses, and lead witness examinations at hearings and trials.
  • Handle discovery and document review, including drafting and responding to requests for production, interrogatories, and requests for admission; manage eDiscovery workflows as needed.
  • Develop and implement case budgets and staffing plans; supervise and mentor junior associates, paralegals, and contract attorneys.
  • Advise clients on litigation exposure, risk assessment, settlement options, and litigation avoidance strategies; coordinate with in-house counsel and external stakeholders.
  • Represent clients in bankruptcy proceedings, contested creditors rights matters, and workouts, including prosecuting or defending adversary proceedings and motions for relief from stay.
  • Participate in oral argument, hearings, mediations and arbitrations and prepare trial exhibits, witness outlines, and trial notebooks.
  • Collaborate with cross-functional teams on complex matters involving regulatory, compliance, or transactional issues related to lending and financial services.

Qualifications

  • Juris Doctor (JD) from an accredited law school and membership in good standing with a state bar.
  • 3+ years of litigation experience at a law firm or as in-house counsel, with a significant focus on commercial litigation; experience may vary depending on role level (Associate).
  • Demonstrated experience in financial services and lending-related litigation, including loan enforcement, foreclosure, securitization disputes, or related matters.
  • Practical experience with bankruptcy litigation and adversary proceedings, including motions for relief from stay and plan-related disputes.
  • Proven courtroom and deposition experience comfortable taking and defending depositions, preparing witnesses for hearings and trials, and conducting direct and cross-examination.
  • Strong motion practice skills, including drafting dispositive motions, oppositions, and appellate briefs.
  • Excellent legal research, writing, and oral advocacy skills; able to produce clear, persuasive pleadings and client memoranda under tight deadlines.
  • Ability to manage multiple matters simultaneously, meet deadlines, work collaboratively with teams and communicate effectively with clients.
  • Experience with eDiscovery tools, document review platforms, and litigation case management software preferred.
  • High ethical standards, sound judgment, and a client-centered approach to problem solving; willingness to travel for hearings and trials as necessary.
