What Does an Employment Law Attorney Do?

An employment law attorney represents employers or employees in labor disputes. Your job duties as an employment law attorney include advising your clients about government labor laws and regulations, reviewing employee handbooks and contracts, and handling cases before the Equal Employment Opportunity Commission (EEOC). The qualifications for a career as an employment law attorney are a law degree, a passing score on the state bar examination, and state licensure to practice law. You need in-depth knowledge of labor laws and strong communication and negotiation skills.

What are the key skills and qualifications needed to thrive as an Employment Law Attorney, and why are they important?

To thrive as an Employment Law Attorney, you need a Juris Doctor (JD) degree, bar admission, and strong expertise in labor and employment statutes and case law. Familiarity with legal research databases like Westlaw or LexisNexis and experience drafting legal documents, contracts, and pleadings are typically required. Exceptional negotiation, analytical thinking, and interpersonal communication skills set outstanding attorneys apart in this field. These competencies are crucial for effectively representing clients, ensuring compliance, and resolving complex workplace disputes.

What are the most common challenges faced by Employment Law Attorneys in their daily work?

Employment Law Attorneys often navigate complex and evolving legal frameworks while managing sensitive workplace disputes. A key challenge is staying up-to-date with frequent changes in federal, state, and local employment regulations. Additionally, attorneys must balance representing their client’s interests with maintaining professionalism, especially during contentious negotiations or litigation. Handling large volumes of documentation, conducting thorough investigations, and collaborating with HR professionals, clients, and opposing counsel are also typical aspects of the role.

What is the difference between Employment Law Attorney vs Labor Relations Specialist?

A Labor Relations Specialist focuses on managing union relationships, negotiating contracts, and ensuring labor law compliance within organizations. The two roles often collaborate but serve distinct functions within employment law and labor management.
