What does a Data Privacy Counsel do?

A Data Privacy Counsel is a legal professional who specializes in advising organizations on data protection laws and privacy regulations. They help ensure that a company’s data practices comply with local and international privacy laws such as GDPR, CCPA, and HIPAA. Their responsibilities include drafting privacy policies, conducting risk assessments, managing data breaches, and providing guidance on data subject rights. They also work closely with IT and compliance teams to implement best practices for data security and privacy. Ultimately, their role is crucial in protecting both the organization and its customers' personal information.

What are some common challenges Data Privacy Counsel face when ensuring compliance across multiple jurisdictions?

Data Privacy Counsel often navigate complex and evolving regulations that differ by country and region, such as the GDPR in Europe and CCPA in California. Ensuring compliance across multiple jurisdictions requires staying up-to-date with legal changes, interpreting ambiguous requirements, and advising business units on practical implementation. Balancing business objectives with legal obligations and managing cross-functional collaboration with IT, security, and compliance teams are also key challenges. Strong communication and adaptability are essential to address conflicting standards and rapidly evolving regulatory landscapes.

To thrive as a Data Privacy Counsel, you need a law degree, strong knowledge of data protection laws like GDPR and CCPA, and experience in privacy compliance and risk management. Exceptional analytical thinking, attention to detail, and the ability to communicate complex legal concepts clearly are valuable soft skills. These skills are crucial for ensuring organizations remain compliant, safeguarding sensitive information, and building trust with stakeholders.
