Hiring a Florida Personal Injury Pre-Litigation Attorney (Must be in South Florida)

We are a personal injury law firm that is on track for aggressive growth, and we need an experienced Personal Injury Pre-litigation Attorney to join our team, working directly with the owner to support the team and help clients.

We love to help people learn and grow. We need a Pre-Litigation Attorney with experience in personal injury. The ideal candidate will be able to take initiative on work that needs to be done and complete tasks with minimal hand-holding. We want to be known for helping clients come out of an extremely emotional process feeling as though they are a better person, in a better position, and that they had a team behind them that really cared and fought for them. We are growing fast, and we need a prelitigation attorney who can hit the ground running.

Initial employment compensation will be based on your experience, with opportunities for increases after that. There is an opportunity for bonus compensation for those who can demonstrate their profitability. If this exciting opportunity appeals to you, please follow the instructions listed below.

Pre-Litigation Attorney Responsibilities

Client Consultation & Intake

  • Meet with new clients to evaluate case merits and explain the legal process and next steps.

  • Gather initial documentation, including police reports, photos, and medical records.

Case Investigation & Evidence Development

  • Conduct fact-gathering: accident reports, treatment history, witness interviews.

  • Coordinate with investigators, accident reconstructionists, and medical experts to build the liability and damages narrative.

  • Identify potential defendants and applicable insurance coverage early.

Medical Treatment Coordination

  • Guide clients through treatment, monitor progress, and secure complete records and billing from providers.

Legal Research & Analysis

  • Analyze relevant statutes, case law, and policy provisions.

  • Assess liability, causation, and damages to determine case value and strategy.

Demand Preparation

  • Draft demand letters covering liability, injuries, treatment, and damages, supported by records, bills, photos, and expert reports.

  • Calculate economic and non-economic damages to maximize recovery.

Settlement Negotiations

  • Negotiate with adjusters and opposing parties pre-suit; counter low offers and pursue policy limits where warranted.

Client Communication

  • Maintain regular contact, provide updates, and set clear expectations on treatment, timeline, and settlement.

Case Strategy & Management

  • Build toward resolution while preserving leverage for suit if needed.

  • Track deadlines, statutes of limitations, and lien resolution.

  • Manage a high-volume caseload using Filevine to keep files organized.

Team Collaboration

  • Work with case managers and staff for timely case progression.

  • Escalate to litigation when pre-suit resolution fails, and prepare a clean file handoff.

Ethics & Professional Development

  • Maintain confidentiality and bar compliance.

  • Stay current on PI law and pre-litigation practice.


Qualifications:

Education

  • Juris Doctor (JD) from an accredited law school.

  • Active bar admission and good standing in the relevant jurisdiction.

Experience

  • 5+ years practicing law, with a focus on personal injury pre-litigation.

  • Proven track record of successful case outcomes and strong settlement results.

  • Experience managing cases from intake through demand and negotiation.
