Intellectual Property Attorney

As an Intellectual Property Attorney and registered patent attorney, you will provide enterprise-wide legal counsel and advocacy to analyze, register and protect The Toro Company’s intellectual property, including patents, trademarks, copyrights and domain names, and avoid the valid intellectual property of others.

What Will You Do?
  • Conduct patentability analysis, including searching, evaluating, preparing claim strategy and drafting applications.

  • Provide IP infringement avoidance counseling.

  • Support IP lawsuits, with and through the assistance of inhouse and external counsel.

  • Monitor competitive IP landscapes.

  • Support IP agreements including license agreements, joint development agreements, nondisclosure agreements, and consulting agreements.

  • Perform supervised merger and acquisition due diligence with respect to IP matters.

JOB DIMENSIONS:

  • Reports to Sr. Director, Chief Product Counsel with overall responsibility for patent matters across the enterprise.

  • Responsible for various IP matters, as assigned, for certain divisions of The Toro Company.

  • Partners with internal and outside legal counsel.

  • Partners with and counsels division leaders and engineering and marketing personnel.

What Do You Need?

Basic Qualifications:

  • Science/Engineering undergraduate degree or equivalent technical credits for USPTO

  • Registration Exam eligibility

  • Juris Doctorate degree from an accredited law school

  • Licensed to practice in relevant jurisdiction(s)

  • 1+ years as a registered patent attorney required

  • Exhibits sound judgment, balancing business needs and legal requirements.

  • Ability to develop and articulate business-minded alternatives and solutions to achieve business objectives.

  • IP license negotiation and drafting experience preferred

  • Excellent communication

  • Efficiently work in both independent and collaborative settings.

Preferred Qualifications:

  • Extensive experience with USPTO patent prosecution.

  • Proven partner to inside and outside legal counsel and teams.

  • Skilled in advising business partners.

  • Two or more years of technical experience.

  • Demonstrates strong organizational and project management skills.

  • Attentive to detail while prioritizing tasks and assignments.

  • Exhibits a professional, hard-working, proactive, enthusiastic and flexible demeanor.

  • Competitive Salary – The pay range takes into account skills, experience, education, and location. It is not common to be hired at or near the top of the range; compensation decisions are dependent on the facts and circumstances of each case. A reasonable estimate of the annual pay range is between ​$120,000 - ​$160,000​. Cash compensation is one piece of our competitive total rewards package. You may be eligible to participate in an incentive program, which rewards employees based on individual and organizational performance.
