Job description

Job Overview:
We are looking for an experienced, motivated attorney with exceptional drafting, negotiation and communication skills. The Attorney will focus will be on drafting, redlining and negotiating large EPC agreements and related exhibits.
To succeed in this position, you should be knowledgeable, proactive and comfortable in a fast-paced environment You should also be an excellent communicator, negotiator, and problem solver.
Responsibilities:
  • Review, modify, and create and negotiate EPC Agreements, that include or contain portions of Owner Supplied Equipment/Owner Scope that appropriately balance risk for the company
  • As needed, assist with negotiating and red-lining engineered equipment contracts, furnish and install subcontracts, and materials/consumables purchase orders.
  • Preparing and negotiation/redlining, demands, settlements and other miscellaneous documents related to ongoing claims, disputes, and change orders related to EPC projects.
  • Staying informed about current legislation and court rulings, especially concerning legal specialties.
  • Familiarity with general insurance concepts, such as waiver of subrogation, builder's risk insurance, professional liability coverage/exclusions, understand self-insured retentions, layers of insurance, and what types of insurance covers certain claims.
  • Understanding of common issues in the EPC energy industry related to limit of liability clauses, waivers of consequential damages, indemnities, Owner Furnished Equipment, and warranties.
  • Provide legal advice in all aspects of construction law, as well as ancillary legal areas applicable in the construction industry, such as disputes related to contract, delay, payment, construction defect, damages, liens, injuries, litigation, and insurance matters, among others.
  • Assist operations in disputes involving third parties, owners, vendors, subcontractors and consultants.
  • Assist project teams in understanding and pursuing insurance coverage for construction defect, builder's risk, pollution, design, auto, worker's compensation and property damage claims while working in conjunction with the Risk Management Department.
  • Select and manage outside counsel with all aspects of litigation - assist in response to document requests and discovery responses, review and edit motions, briefs and memoranda from outside counsel; manage outside counsel throughout the pre-litigation and litigation processes.
  • Assist in preparation for and attend alternative dispute resolutions.
  • Provide legal counsel to internal clients by analyzing their situation, defining their needs, and determining a proper legal strategy and course of action on claims, injuries, human resources issues and more.
  • Provide general legal advice to as needed to company employees.

Basic Qualifications:
  • Juris Doctor degree from an American Bar Association accredited law school.
  • 7-12 or more years of experience similar to that described .
  • Admission to the bar in the state in which you intend to practice.
  • Experience or expertise in a specific branch of law may be preferred.
  • Commitment to abiding by local, state, and federal laws and behaving ethically.
  • Ability to work independently or with a team of attorneys to develop strategies.
  • Strong critical thinking, interpersonal, public speaking skills.
  • Ability to negotiate, research, and communicate verbally and in writing effectively.
  • Adaptability and attention to detail.
  • Preferred: Undergrad work/degree, in construction management, engineering, or field related to the construction industry, e.g., finance, management, procurement, or supply chain.
