What is an ERISA fiduciary?

An ERISA fiduciary is an individual or entity responsible for managing an employee benefit plan and its assets under the Employee Retirement Income Security Act of 1974 (ERISA). Fiduciaries must act solely in the interest of plan participants and beneficiaries, adhering to strict standards of loyalty and prudence. Their duties include managing plan assets, following plan documents, and avoiding conflicts of interest. Failing in these responsibilities can result in personal liability for losses to the plan.

What are the three types of fiduciaries?

In the context of ERISA fiduciaries, there are three main types: functional fiduciaries who make investment decisions, administrative fiduciaries who handle plan operations, and investment advisors who provide investment advice. Each type has specific responsibilities and legal obligations to act in the best interest of plan participants and beneficiaries.

What are the 5 major responsibilities of a fiduciary?

A fiduciary, including an ERISA fiduciary, has five major responsibilities: to act solely in the best interest of plan participants and beneficiaries, to act with prudence and due diligence, to follow plan documents and legal requirements, to avoid conflicts of interest, and to diversify plan assets to minimize risk. These duties require careful oversight, adherence to regulations, and ethical conduct to ensure proper management of retirement plans.

What are the key skills and qualifications needed to thrive as an ERISA Fiduciary, and why are they important?

To thrive as an ERISA Fiduciary, you need a deep understanding of ERISA regulations, retirement plan administration, and financial management, often supported by a bachelor's degree in finance, accounting, or law. Familiarity with compliance management systems, investment analysis tools, and relevant certifications such as the Accredited Investment Fiduciary (AIF) designation is typically required. Strong analytical thinking, ethical judgment, and clear communication are essential soft skills in this role. These skills are crucial for ensuring legal compliance, protecting plan participants' interests, and managing complex financial responsibilities effectively.

Is a custodian an ERISA fiduciary?

A custodian is generally not considered an ERISA fiduciary because their role is limited to safekeeping and holding plan assets, not making investment decisions or providing investment advice. ERISA fiduciaries are typically plan sponsors, trustees, or individuals with discretionary authority over plan management. However, if a custodian exercises discretion or provides investment advice, they could be classified as fiduciaries under ERISA rules.

What does it mean to be an ERISA fiduciary?

An ERISA fiduciary is a person or entity responsible for managing employee benefit plan assets in the best interests of plan participants and beneficiaries, in accordance with the Employee Retirement Income Security Act (ERISA). They must adhere to strict standards of loyalty and prudence, often requiring certification or experience in retirement plan management. Fiduciaries are legally obligated to act solely in the interest of plan participants and may be held liable for breaches of their duties.
