What does a disability rights attorney do?

A Disability Rights Attorney is a legal professional who advocates for the rights of individuals with disabilities. They work on cases involving discrimination, accessibility, education, employment, and public accommodations under laws like the Americans with Disabilities Act (ADA). These attorneys may represent clients in court, negotiate settlements, and provide guidance on legal compliance. Their goal is to ensure that people with disabilities receive equal opportunities and are protected from unfair treatment.

What are the key skills and qualifications needed to thrive as a disability rights attorney, and why are they important?

To thrive as a Disability Rights Attorney, you need a law degree, active bar membership, and in-depth knowledge of disability law, such as the ADA and Section 504. Familiarity with legal research databases, case management software, and courtroom procedures is typically required. Exceptional advocacy, empathy, and strong written and verbal communication skills help build trust with clients and influence legal outcomes. These skills are vital to effectively represent individuals with disabilities, ensure compliance, and drive systemic change.

What are some common challenges disability rights attorneys face when advocating for clients?

Disability Rights Attorneys often encounter challenges related to complex and evolving regulations, balancing large caseloads, and navigating bureaucratic systems to secure accommodations and protections for clients. They may need to educate employers, schools, or public entities on compliance with the Americans with Disabilities Act (ADA) and other relevant laws. Additionally, building trust with clients—who may have experienced discrimination or systemic barriers—requires empathy, patience, and strong communication skills. Collaborating with social workers, healthcare professionals, and advocacy groups is also a key part of the role.

Job description

Shumaker is seeking a junior Litigation Associate to join its nationally recognized Insurance Recovery practice in the Akron office. The ideal candidate will have at least two years of complex litigation experience and an interest in representing corporate policyholders in multi-faceted insurance coverage and recovery matters.
This attorney will work closely with leading insurance recovery practitioners and litigators to help clients recover insurance assets, resolve coverage disputes, and pursue claims involving a broad range of commercial insurance products. The position offers meaningful responsibility, direct client exposure, and significant opportunities for professional growth.
Candidates with experience in one or more of the following areas are particularly encouraged to apply:
  • Insurance coverage and bad-faith litigation
  • Commercial or business litigation
  • Construction litigation
  • Environmental litigation
  • Professional liability matters
  • Property and business interruption claims
  • Appellate advocacy

The successful candidate will be an intellectually curious, business-minded litigator who enjoys solving complex coverage issues, advocating for policyholder rights, and helping clients maximize the value of their insurance assets. Experience representing policyholders is preferred but not required; candidates with strong commercial litigation backgrounds and an interest in developing an insurance recovery practice will be considered.
Where You'll Work
This attorney will work in Shumaker's Akron office under a hybrid work arrangement.
What You'll Do
  • Represent corporate policyholders in insurance recovery and coverage matters.
  • Analyze insurance policies, coverage positions, reservation-of-rights letters, and denial letters.
  • Assist clients in presenting insurance claims to carriers.
  • Conduct legal research and prepare coverage analyses, client memoranda, and strategic recommendations.
  • Draft pleadings, dispositive motions, discovery requests and responses, briefs, and appellate filings.
  • Manage fact and expert discovery, including document review, depositions, and witness preparation.
  • Take and defend depositions, commensurate with experience.
  • Participate in mediations, arbitrations, and settlement negotiations.
  • Appear in state and federal courts, commensurate with experience.
  • Work closely with senior attorneys on case strategy and litigation management.
  • Communicate effectively with clients, experts, and opposing counsel.
  • Manage caseloads efficiently while meeting litigation deadlines and billable requirements.

What We're Looking For
  • A minimum of two years of complex litigation experience required.
  • Juris Doctor degree from an ABA-accredited law school.
  • Active Ohio bar license required, or ability to waive in.
  • Experience with commercial litigation, insurance coverage, construction litigation, business disputes, or related matters preferred.
  • Strong legal research, writing, and advocacy skills.
  • Experience drafting substantive motions and managing discovery.
  • Deposition experience preferred.
  • Ability to manage multiple matters and work effectively in a collaborative team environment.
  • Excellent interpersonal and client-service skills.
