ESSENTIAL DUTIES AND RESPONSIBILITIES

Responsible for the ongoing development, implementation, and review of an effective Corporate Compliance Program for Mary Cariola Center

Serves as the agency’s Privacy Officer:

A HIPAA Privacy Officer, also known as a chief privacy officer (CPO), isresponsible for ensuring that a healthcare organization complies with the Health Insurance Portability and Accountability Act (HIPAA).Their duties include:

  • Develops and implements policies:Create and oversee policies and procedures to protect patient health information (PHI)
  • Trains employees:Provide ongoing training on privacy protocols for staff
  • Conducts reviews:Regularly review compliance with HIPAA regulations
  • Manages complaints:Handle inquiries and complaints about patient privacy rights
  • Investigates incidents:Investigate potential breaches of PHI & PII and report them as necessary
  • Ensures patient rights:Protect patient rights and confidentiality in accordance with state and federal laws
  • Coordinates with legal consultants:Work with legal consultants to develop and monitor agreements with business associates
  • Creates legally required documents:Develop documents and forms such as the Notice of Privacy Practices, Consent, and Authorization
  • Establishes criteria:Establish criteria for meeting HIPAA requirements, such as procedures for releasing information and de-identifying PHI
  • Serves as a point of contact:Be the first point of contact for government authorities and answer questions if an incident occurs
  • Oversees the development, communication, and implementation of agency policies
  • Works with agency leaders to develop a regular schedule of internal department audits and creates schedule to report out to Quality and Compliance committee of the Board
  • Acts as an institutional resource in applicable regulations of oversight agencies (e.g., Medicaid, New York State Department of Education, OPWDD)
  • Maintains current knowledge of regulations and funding of services through effective networking with colleagues at peer agencies, review of literature and participation in seminars and educational programs
  • In collaboration with the President/CEO, establishes agenda for Quality and Compliance committee of the Board and participates in meetings
  • Participates as an active member of the agency leadership team
  • Acts as the agency’s primary resource for internal investigations; provides investigation trend reporting to the Quality & Compliance Committee
  • Ensures confidential, secure storage of information relating to agency investigations and contracts
  • Prepares and tracks professional services contracts including their required insurance verification, credentialing, and affirmations, and their renewal in consultation with agency leadership
  • Reviews other agency contracts as needed
  • Drafts compliance-related policies and procedures for senior management and Quality & Compliance Committee approval
  • Develops, and disseminates corporate compliance training to new hires, employees, and board members
  • Develops and implements annual Corporate Compliance operational workplan for continuous improvement
  • Partners with department directors to foster understanding of a variety of topics, including corporate compliance, risk and safety management, compliance with regulations
  • Creates productive working relationships with internal and external strategic partners, team members, staff, and regulators
  • Develops technical expertise related to the regulatory aspects of agency services
  • In collaboration with the Director of Information Technology/agency Security Officer, ensures compliance with requirements for privacy and security risk assessments
  • Identifies and builds on strengths, and constructively identifies areas of growth for performance and quality improvement; follows up on recommendations for areas of quality improvement
  • Remains well informed on local, state, and national issues affecting the well-being of children and families
  • Demonstrates effective public speaking and facilitation skills
  • Builds successful relationships with the Board of Directors, and reports directly to the Quality & Compliance Committee on matters of corporate compliance
  • Participates in executive sessions of the Board of Directors as requested.
  • Ensures annual review and update of the Compliance Plan and policy and reports outcome to Board of Directors
  • Coordinates annual review and updates to the Employee Handbook and Supervisor’s guide
  • Conducts agency investigations of reported violations of agency policies and procedures, including Code of Conduct

QUALIFICATIONS

EDUCATION and/or EXPERIENCE

Bachelor’s Degree and/or combination of advanced degrees and experience; Master’s degree preferred.

Five years minimum management experience in designing and/or implementing quality improvement risk management systems. Experience with organizational change and developing systems to move the organization forward. Track record of leadership and management skills, superb communication and listening skills, a lifelong learner of creative problem solving.

LANGUAGE SKILLS

Ability to read, analyze, and interpret common scientific and technical journals, financial reports, and legal documents. Ability to respond to common inquiries or complaints from customers, regulatory agencies, or members of the business community. Ability to communicate effectively and courteously with board members and agency personnel. Ability to deliver effective presentations to large audiences and board members. HIPAA Privacy Officers should have a thorough understanding of HIPAA and related federal and state privacy laws and regulations.They should also have strong communication, analytical, and critical thinking skills.

REASONING ABILITY

Ability to define problems, collect data, establish facts and draw valid conclusions. Ability to interpret an extensive variety of technical instructions in mathematical or diagram form and deal with several abstract and concrete variables. Ability to think abstractly and then convey abstract thoughts in an easy-to-understand format.

OTHER KNOWLEDGE, SKILLS AND ABILITIES

Knowledge of regulations of multiple oversight agencies, including Medicaid, New York State Department of Education, and OPWDD. Familiarity with complex laws and regulations. Ability to obtain and maintain respect of board members and agency personnel. Ability to manage several projects simultaneously. Ability to work in a PC environment with database management experience.
