AspectBankruptcyCredit Counselor
Required CredentialsLegal education, bankruptcy law knowledge, often a law degree or certificationFinancial counseling certification, such as Certified Credit Counselor (CCC)
Work EnvironmentLaw firms, courts, or bankruptcy courtsNon-profit agencies, financial institutions, or credit counseling agencies
Industry UsageLegal and financial sectors dealing with debt resolutionFinancial services, debt management, and consumer assistance
Common Search/ComparisonOften compared for debt relief options and legal processesCompared for debt management and financial planning

Bankruptcy and credit counselors both assist individuals with debt issues, but they serve different roles. Bankruptcy involves legal proceedings to eliminate or restructure debt, requiring legal expertise. Credit counselors provide financial advice and debt management plans without legal action. Understanding these differences helps individuals choose the right professional for their financial situation.

What are the key skills and qualifications needed to thrive as a Bankruptcy Attorney, and why are they important?

To thrive as a Bankruptcy Attorney, you need a Juris Doctor (JD) degree, a state bar license, and a thorough understanding of bankruptcy law and financial restructuring. Familiarity with legal research databases, bankruptcy court filing systems (like PACER), and specialized bankruptcy software is typically required. Outstanding negotiation, analytical thinking, and client communication skills help professionals stand out in this field. These competencies are crucial for effectively advising clients, navigating complex legal proceedings, and achieving optimal outcomes in high-stakes financial situations.

What are some common challenges faced by bankruptcy professionals, and how can these be managed effectively?

Bankruptcy professionals often encounter complex cases involving multiple stakeholders, tight deadlines, and emotionally charged situations with clients facing financial distress. Managing these challenges requires strong organizational skills, clear communication, and the ability to prioritize tasks under pressure. Building expertise in bankruptcy law, maintaining up-to-date knowledge of regulations, and collaborating closely with colleagues such as paralegals, accountants, and trustees are essential for effective case management and achieving successful outcomes for clients.

What are bankruptcy professionals?

Bankruptcy professionals are experts who assist individuals or businesses during the bankruptcy process, helping them navigate complex legal and financial situations. This group includes bankruptcy attorneys, trustees, financial advisors, and credit counselors, all of whom provide guidance on debt relief options, legal proceedings, and asset management. Their goal is to help clients understand their rights, fulfill legal requirements, and achieve the best possible outcome based on their unique circumstances.

Job description

Bankruptcy Attorney Opportunity at Cotten Schmidt
Cotten Schmidt is a dynamic, collaborative, and tech-forward firm headquartered in Fort Worth, Texas, with additional offices in New Orleans, Corpus Christi, and Houston. We are currently seeking an experienced Bankruptcy Attorney to join our team. Whether you bring a portable book of business or not, we want to discuss how our approach can elevate your practiceโ€”covering Chapter 7, Chapter 11, Chapter 13, creditor representation, and more.

About Cotten Schmidt

At Cotten Schmidt, we welcome established rainmakers, rising leaders, and attorneys who value greater control over their practice. Our firm thrives on innovation and collaboration, offering the support and resources you need to excel in bankruptcy law.

Why Join Us?

Transparent, Results-Driven Compensation
In many traditional law firms, compensation is determined each year by a select senior lawyer or committee, which can be subjective and undervalue your contributions. We reject this old-school approach. Our compensation system directly rewards the hours you bill, the clients you bring in, and the business you refer to colleagues. A newly employed attorney with a bankruptcy practice can quickly become one of the highest-compensated attorneys in the firm.

Flexible Work Options
Work from any of our four officesโ€”or from wherever you thrive. We offer fully remote, hybrid, part-time, and full-time arrangements. Youโ€™ll have the flexibility to manage your bankruptcy caseload in the environment that suits you best.

Long-Term Growth & Leadership Opportunities
As a bankruptcy attorney, youโ€™ll have the opportunity to build and shape our Bankruptcy & Restructuring Practice Group. Develop your leadership skills, mentor junior attorneys, and collaborate with other high-performing partners to grow a robust practice.

Comprehensive Benefits
Your overall well-being is our priority. We offer a robust medical benefits packageโ€”along with other competitive benefitsโ€”so you can focus on your bankruptcy clients and your practice with peace of mind.

Robust Referral Network
Tap into our firm-wide infrastructure of cross-practice collaboration. Gain referrals from colleagues working in corporate transactions, litigation, or other areas that intersect with bankruptcyโ€”and refer out work to build stronger client relationships.

Who Weโ€™re Looking For

  • Practice Leaders in Bankruptcy: If youโ€™re an experienced bankruptcy attorney who can independently handle matters such as Chapter 7, Chapter 11 or Chapter 13 cases, debt restructuring, and creditorsโ€™ rights, we have a platform to support you.
  • Entrepreneurs & Innovators: If you want autonomy over your practice and the chance to maximize earnings based on productivity, this is your ideal platform.
  • Mentors & Team Builders: We seek partners who are enthusiastic about developing junior attorneys, fostering an inclusive team environment, and shaping the culture of our Bankruptcy & Restructuring Practice Group.

Ideal Qualifications

  • 5+ years of experience in bankruptcy law at a law firm, with demonstrated leadership and an ability to run matters from inception to resolution.
  • Portable book of business is welcome (and can rapidly accelerate your compensation), but not required.
  • Courtroom or substantial negotiation experience in Chapter 7, Chapter 11, Chapter 13 or related bankruptcy proceedings; comfort handling complex restructurings, creditor negotiations, and other high-stakes matters.
  • Licensed to practice law in Texas or Louisiana (or eligible to waive in, depending on office location).

Letโ€™s Talk

If youโ€™re ready to take the next step in your bankruptcy law career, contact us for a confidential conversation. Weโ€™ll run the numbers togetherโ€”based on your current productivity and portable businessโ€”to show exactly how our transparent compensation structure can enhance your professional and financial growth.

Cotten Schmidt is an Equal Opportunity Employer. We welcome all qualified applicants who seek an environment where success is measured by your accomplishmentsโ€”not your connections. Letโ€™s discuss your future as a Bankruptcy Attorney at Cotten Schmidt.
