Intellectual Property Attorney

About the Role:

We are seeking an experienced Intellectual Property Attorney with 5+ years of experience to join our growing legal team in Scottsdale, Arizona. This hybrid opportunity is ideal for an attorney who is passionate about helping businesses, entrepreneurs, innovators, and technology companies protect, manage, and maximize the value of their intellectual property assets.

The successful candidate will advise clients on a broad range of intellectual property matters, including trademark, copyright, trade secret, licensing, brand protection, and intellectual property strategy. Candidates with patent experience are encouraged to apply, though patent prosecution is not required. This role offers the opportunity to work closely with clients across diverse industries while collaborating with attorneys in corporate, litigation, real estate, and business law practices.

Responsibilities:
  • Advise clients on intellectual property strategy, portfolio development, and risk management.
  • Prepare, file, and prosecute U.S. and international trademark applications.
  • Conduct trademark clearance searches, analyze results, and provide legal opinions.
  • Draft, review, and negotiate intellectual property agreements, including licensing, assignment, confidentiality, technology transfer, and coexistence agreements.
  • Counsel clients on copyright registration, licensing, enforcement, and brand protection matters.
  • Advise businesses on trade secret protection, intellectual property ownership, and commercialization strategies.
  • Handle trademark opposition, cancellation, enforcement, and dispute resolution matters before the USPTO and other tribunals.
  • Conduct intellectual property due diligence in connection with mergers, acquisitions, financing transactions, and other corporate matters.
  • Collaborate with attorneys across multiple practice groups to develop comprehensive legal solutions for clients.
  • Stay current on developments in intellectual property law and proactively advise clients on emerging legal and business risks.
Qualifications:
  • Juris Doctor (JD) from an accredited law school.
  • Active membership in good standing with the Arizona State Bar, or eligibility for admission.
  • Minimum 5 years of intellectual property law experience.
  • Strong experience with trademark prosecution, trademark portfolio management, and intellectual property counseling.
  • Experience drafting and negotiating intellectual property licensing and commercial agreements.
  • Excellent legal research, writing, negotiation, and analytical skills.
  • Strong client relationship management and communication abilities.
  • Ability to independently manage multiple client matters while collaborating within a team-oriented environment.
Desired Qualifications:
  • Experience representing startups, entrepreneurs, emerging growth companies, or closely held businesses.
  • Experience with copyright, trade secrets, licensing, and brand protection.
  • Familiarity with technology, software, manufacturing, consumer products, life sciences, or other innovation-driven industries.
  • Experience conducting intellectual property due diligence for mergers and acquisitions.
  • USPTO registration and patent prosecution experience is a plus, but not required.
  • Portable book of business is welcomed but not required.
