Job description

Senior Attorney, RE & Construction Litigation & Transactions being hired at our law firm client - a fast-growing, boutique specialist in the area of RE & Construction Litigation and Transactions in midtown Manhattan (0.5 miles from Penn/GCS). Base salary approximately $275k to $350k, plus bonus, plus fully-pd FAMILY medical coverage, plus origination fees, plus 401k. The primary focus of the role for the first 6-12 months is to file / litigate / handle RPAPL 881 / adjoining property access matters in NYC. Candidates MUST have strong 'hands on' experience with RPAPL 881. Quick interview process - ONE meeting with the Partners and done. June start.


The Senior Attorney, RE & Construction Litigation & Transactions is a newly-created position as a result of strong business growth and pipeline. Quick interview process - ONE meeting with the Partners and done.

This is a 'hands on' role owning cases beginning to end, representing owners, developers, architects, engineers & contractors in NYC re commercial construction & RE litigation and transactions matters such as construction defects, RPAPL 881, mechanic's liens, project delays, contract disputes, encroachment, warranty claims, workmanship, etc. Negotiate, prepare & review legal docs, appear in court, etc.

Base salary approximately $275k to $350k, plus bonus, plus origination fees on new business brought in, plus 100% firm paid FAMILY medical insurance, plus 401k!

A book of business is a plus but NOT REQUIRED!

Candidate will be expected to maintain client relationships and must have strong communication and interpersonal skills. Prior appearances in court conferences and hearings required.

The work is on site 5 days/wk at the firm's midtown office, with flexibility to work remotely for inclement weather, personal reasons, etc. now and then.

Key Responsibilities:

  • Own and perform all aspects of RE & commercial construction litigation and transactions from beginning to end with little oversight
  • Own - file / litigate / process RPAPL 881 litigation matters in NYC. This is the primary focus for this role for the first 6-12 months.
  • Draft pleadings, briefs, affidavits and other legal documents / filings (NOTE: the firm has Paralegals to assist, however this is a 'hands on' role drafting legal docs w/ Paralegal assistance)
  • Appear in court
  • Oversee and help manage 3 Associate Attorneys
  • Perform legal research, discovery, analyze complex legal matters, prepare legal memoranda

Key Requirements:

  • ~6-12+ TOTAL years of litigation experience, with 3 - 6+ years having owned diverse commercial construction & RE litigation cases beginning to end; RPAPL 881 / adjoining property access litigation experience REQUIRED.
  • NY J.D.
  • Substantial experience appearing in NY courts, preferably including Supreme Court.
  • Must be a litigator, able to analyze and research complex legal matters, perform discovery, prepare appropriate legal documents, and handle client cases beginning to end
  • Strong Contract Law experience
  • Strong experience with client relations
  • Excellent research experience and ability
