What is an overnight pre litigation attorney?

Overnight Pre Litigation Attorneys are legal professionals who work outside of traditional business hours, often during the night, to handle legal matters that arise before a lawsuit is officially filed. Their main responsibilities include assessing potential cases, gathering evidence, communicating with clients, and preparing legal documents to resolve disputes early. By working overnight, they ensure that urgent legal issues are addressed promptly, providing continuous support to clients and law firms. This role is especially common in law firms that operate nationwide or handle time-sensitive cases. These attorneys help prevent litigation by negotiating settlements and advising clients on the best course of action.

What skills and qualifications are needed to be an overnight pre litigation attorney?

To thrive as an Overnight Pre Litigation Attorney, you need a Juris Doctor (JD), active state bar licensure, and a strong understanding of civil litigation and case evaluation. Familiarity with legal research databases (like Westlaw or LexisNexis), case management software, and electronic filing systems is typically required. Excellent written communication, attention to detail, and the ability to work independently under tight deadlines make a candidate stand out. These skills are crucial for effectively handling urgent legal matters, ensuring compliance, and maintaining high-quality client service during overnight hours.

What challenges do overnight pre litigation attorneys face working overnight, and how can they manage them?

Overnight Pre Litigation Attorneys often need to adjust to non-traditional hours, which can affect work-life balance and communication with colleagues who work daytime shifts. Managing fatigue and staying organized are key, as urgent case developments or client needs can arise unexpectedly during the night. It's important to establish clear communication protocols with day teams and utilize digital tools to maintain seamless case handoffs. With effective time management and strong collaboration skills, attorneys in this role can ensure client matters are handled efficiently around the clock.

Job description

Our California-based personal injury firm is seeking a Pre-Litigation Attorney to lead and elevate our pre-litigation settlement operation. This is a key leadership role for an attorney who excels at case valuation, settlement strategy, and client communication—and who enjoys building and managing a high-performing team.

This position is ideal for a PI attorney who wants meaningful responsibility, autonomy, and impact, without the grind of constant court appearances.

What You’ll Do

  • Lead the pre-litigation settlement team, including oversight of settlement negotiations and workflow
  • Evaluate, value, and negotiate personal injury cases (primarily motor vehicle accidents) from intake through settlement
  • Serve as the escalation point for client concerns, including dissatisfied or high-touch clients, and resolve issues with professionalism and confidence
  • Develop settlement strategies to maximize results while keeping cases moving efficiently
  • Hire, train, and mentor pre-litigation staff and junior team members
  • Improve systems and processes within pre-litigation to enhance client experience, efficiency, and results
  • Collaborate closely with litigation attorneys to ensure clean handoffs when cases do not resolve pre-suit

What We’re Looking For

  • A proactive problem-solver who takes ownership and doesn’t wait to be told what needs fixing
  • A strong negotiator who understands both case value and insurer psychology
  • A calm, confident communicator who can de-escalate difficult client situations and build trust
  • A leader and mentor who enjoys training and developing people—not just managing files

Requirements

  • Ability to accurately evaluate and value pre-litigation PI cases
  • Proven experience handling settlement negotiations with insurance carriers
  • Strong client-facing skills, including managing expectations and difficult conversations
  • Ability to hire, train, and onboard new team members effectively
  • Tech-savvy and comfortable working in a remote-first environment

Qualifications

  • 2+ years of personal injury pre-litigation experience at a mid-size or large PI firm
  • Active California Bar license (required)
  • Experience working with modern PI case-management systems (Filevine or similar a plus)
  • Strong organizational and leadership skills

Why This Role

  • Leadership position with real authority and influence
  • No court appearances—focus on strategy, negotiation, and results
  • Opportunity to build and shape a team, not just manage a desk
  • Competitive compensation based on experience and performance
  • Remote flexibility with a firm that values efficiency, accountability, and professionalism
