Job Summary

The Chief Assistant Solicitor assists the Solicitor as the sole representative of the State of Georgia in the State Court of Hall County. The Chief Assistant Solicitor is a resource for and mentors the Assistant Solicitor’s in their trial preparation, during trial, and in any post-trial proceedings. This position will represent the State in more complex cases.

Essential Functions & Responsibilities

Advises Assistant Solicitors in all case matters especially in complex cases during the preparation stages, during trial, and in all appellate matters. Researches case law and prepares briefs.

Maintain current knowledge of recent case law and statutory provisions that may be applicable to cases handled by the Solicitor’s Office.

Drafts and advises less experienced staff members in the drafting of discovery documents and responses, pleadings, motions, and judgements.

Draft accusations and aide Assistant Solicitors in drafting accusations.

Advise less experienced staff members in the formulation of sentencing recommendations.

Evaluates and aides less experienced staff members in the evaluation of the merits of criminal cases and determines what further action will be taken.

Argue appellate motions in the Georgia Court of Appeals and Supreme Court and the United States District Court and Court of Appeals.

Aids appropriate county or state attorneys in the representation of the custodian in habeas corpus matters.

Evaluates and advises in the evaluation of certain aspects of pending cases recommending bond amounts.

Conduct preliminary hearings.

Negotiate pleas with defense counsel.

Prosecute assigned cases of court, inkling Traffic and Magistrate Court.

Interview investigating officers and witnesses.

Assist citizens, law enforcement, and attorneys, non-attorney staff members, both inside and out of the county.

Train less experienced attorneys in the office.

Performs other relevant work as assigned.

Regular and predictable attendance is required


Minimum Qualifications Required

Education and Experience:

Juris Doctorate

Six years of previous relevant experience including progressively competent legal performance. Supervisory experience that includes proficiency in case management and the supervision of legal staff.

Any equivalent combination of education and experience which provides the minimum level of qualifications stated above.


Licenses and Certifications:

Possess and maintain a valid membership in the State Bar Association of Georgia, the Court of Appeals fo the State of Georgia, and the Supreme Court of the State of Georgia.

Valid Class C Driver's License and a satisfactory Motor Vehicle Record (MVR).


Knowledge, Skills and Abilities:

Proficiency in conducting bench and jury trials.

Proficiency in negotiating plea arguments.

Demonstrated knowledge of and respect for the Code of Professional Responsibility of the State Bar Association of Georgia.

Ability to read and interpret advanced professional materials.

Ability to write extremely complex reports and papers.

Ability to speak to high level professional groups.

Ability to negotiate or exchange ideas, information, and opinions with others to formulate policies and programs, or arrive jointly at decisions, conclusions, or solutions.

Ability to integrate analysis of data or information to discover facts or develop knowledge or interpretations; modify policies, procedures, or methodologies based on findings.

Ability to communicate effectively both orally and in writing.

Physical Ability:

Essential functions of this position continuously require the ability to remain in a stationary position (sitting or standing); operate a computer and other office machinery, such as a calculator, copier, and printer. Incumbents must continuously be able to think analytically; handle stress and emotion, concentrate on tasks, remember names and other details; examine and observe details; make decisions, and adjust to change. Essential Functions frequently require the ability to move about inside the office; and move/transport items up to 10lbs.

Essential functions occasionally require the ability to bend body downward and forward by bending spine and legs, and twisting at the waist, hips or knees; reach overhead; push or pull; and repetitively use hands/arms/legs. Incumbents in this position are occasionally required to be on-call and work irregular hours.

Sensory Requirements:

Essential functions regularly require the ability to use effective verbal and written communication; and use of hand/eye coordination and fine manipulation to use equipment.
