Job Description Summary:

This position provides overall labor compliance support to ensure construction projects comply with labor laws, prevailing wage requirements, and project-specific labor requirements across all markets. Serves as an escalation point on complex matters and supports with educating on labor compliance processes and procedures.

Job Description:

POSITION RESPONSIBILITIES AND DUTIES

  • Able to perform all essential Labor Compliance Specialist I responsibilities.
  • Responsible for labor compliance activities on assigned projects across any market including identifying labor compliance requirements and project set up.
  • Review all public contracts (and any private projects that have specific requirements) for labor requirements (certified payroll, skilled labor, local hire, diversity, and other labor related requirements). Work with project teams and departments to develop and implement a plan to monitor, report, and ensure proper submissions to agencies.
  • Communicate specific labor compliance requirements to subcontractors/vendors, obtain necessary documents, and monitor documentation to release payment.
  • Monitor and audit certified payroll for internal self-perform and external subcontractors.
  • Perform audits on projects and communicate issues or non-compliant items to appropriate parties to resolve.
  • Develop risk assessments on Compliance Programs and escalate issues to senior labor compliance team members to assist with identifying appropriate solutions.
  • Participate in third party / Government reviews, audits and inquiries. Compile necessary information/documents and work with appropriate departments and senior labor compliance staff to address issues.
  • Identify and resolve grievances - escalate complex matters to appropriate party.
  • Competently handle audits by third parties and submit to agencies, clients, or other requestors.
  • Review and verify payroll records, benefit statements, employer training contributions, apprenticeship paperwork, and other relevant documents to determine compliance with applicable rules and regulations.
  • Use LCP Tracker and other compliance software to review and approve certified payroll and payroll documents.
  • Travel to job sites for pre-construction meetings, training/education, and relevant activities, as necessary.
  • Create and maintain positive relationships with stakeholders and contractors. Develop relationships with agencies and client representatives to establish ongoing communication and partnership.
  • Facilitates internal communication between operations and relevant departments on labor compliance matters.
  • Conducts training for teams and/or division stakeholders, program employees, and contractors as needed.
  • Monitor and stay abreast of applicable laws and regulations that might affect the Swinerton's policies and procedures.
  • Demonstrate knowledge and application with federal reporting requirements for Swinerton projects (when applicable) and complete the associated reports in a timely manner.
  • Complete other responsibilities as assigned.

MINIMUM SKILLS AND EXPERIENCE

  • 6+ years of labor compliance experience in the construction industry.
  • Bachelor of Arts/Science Degree in business or related degree desired and/or equivalent working experience.
  • Minimum of 3 experience working with Public Works Labor Compliance Programs and/or Project Labor Agreement
  • Significant understanding of relevant labor codes/laws
  • Demonstrated applicable knowledge of employment practices in the construction industry and a strong working knowledge of state labor regulations
  • Extensive experience with prevailing wage enforcement, analyzing data, risk assessment, and auditing
  • Computer proficiency including word processing and spreadsheet applications
  • Knowledge and experience with LCP Tracker, OCPS, Elations, ecomply, DIR eCPR, other agency portals preferred.
  • Proficient written and verbal English communication skills, including business writing skills
  • Ability to work independently, accurately, strategically, resourcefully, yet intuitively know when and how to inform, verify, collaborate, and escalate.
  • Experience implementing procedures and coordinating with other internal and external departments
  • Ability to work in a dynamic environment across the Swinerton organization, providing compliance guidance to a variety of teams and senior management.
  • Ability and means to travel as needed.
