Position Overview
We are seeking an IP Litigation Associate with strong bio-pharmaceutical technical background to join our intellectual property litigation team. The role focuses on patent litigation and counseling for clients in the pharmaceutical and biotech sectors, with particular emphasis on small-molecule and molecular biology technologies. The associate will handle all phases of complex patent disputes Hatch-Waxman/ANDA and Paragraph IV litigation, PTAB proceedings, federal appeals, claim construction, discovery, expert management, and trial support while advising clients on freedom-to-operate, patent prosecution coordination, and transactional/IP due diligence.
Key Responsibilities

• Manage and litigate patent disputes in the bio-pharma space including Hatch-Waxman/ANDA and Paragraph IV actions, coordinating docketing and case strategy.
• Draft and argue briefs, motions (summary judgment, preliminary injunctions, Daubert, claim construction/Markman), and appellate filings for the Federal Circuit.
• Handle PTAB proceedings (IPR/PGR) including preparation and defense of petitions and post-grant litigation strategy.
• Perform infringement and invalidity/prior-art analyses; prepare infringement contentions, claim charts, and detailed expert reports.
• Retain, prepare, and manage scientific and damages experts, conduct expert depositions, and coordinate expert discovery.
• Lead discovery strategy and e-discovery workflows (Relativity, Clearwell), manage document review teams, and coordinate PACER/ECF docketing.
• Advise clients on FDA regulatory interfaces, Orange Book practice, and CMC-related issues impacting patent strategy and litigation.
• Prepare and deliver opinion letters (invalidity, non-infringement, freedom-to-operate) and conduct FTO analyses and IP portfolio due diligence.
• Support patent prosecution and drafting as needed to align litigation and prosecution strategies; handle USPTO practice and EFS-Web filings.
• Assist with licensing, transactional support, NDA/confidentiality drafting, trade secret protection, and negotiating IP-related agreements.
• Develop litigation budgets, manage case timelines and client communications, and supervise junior associates and paralegals during matter execution.

Qualifications

• Juris Doctor (J.D.) degree and active bar admission in at least one U.S. jurisdiction.
• 3+ years of patent litigation experience, preferably with a focus on bio-pharmaceutical matters (Hatch-Waxman/ANDA experience a plus).
• Technical background in pharmaceutical sciences, molecular biology, biochemistry, medicinal chemistry, or related field (advanced degree preferred).
• Demonstrated experience with small-molecule patent issues, claim construction, infringement and invalidity analyses, and managing technical experts.
• Strong writing, oral advocacy, and legal research skills; experience drafting motions, briefs, and opinion letters.
• Experience with e-discovery platforms and litigation tools (Relativity, Clearwell), PACER/ECF docketing, and document review management.
• Comfortable working with cross-functional teams including in-house counsel, regulatory, CMC and R&D scientists.
