Global Commercial Operations Counsel

What you will do

Let's do this. Let's change the world. Amgen manufactures and markets biopharmaceutical products that are subject to oversight and regulation by several entities of the U.S. Federal government. In this vital role you will be responsible for counseling Amgen's commercial value and access organization on a wide variety of legal and regulatory issues concerning complex contracting and pricing strategies, as well as sales and marketing activities, of biopharmaceutical products in the United States.

Responsibilities

The responsibilities of this position will be partially dependent on the skillset of the successful candidate and may include one or more of the following:

  • Advising and counseling on complex commercial transactions on price concession strategies and risk mitigation with members of the healthcare community (managed care organizations, hospitals, Group Purchasing Organizations (GPO) and distributors), with emphasis on the Anti-Kickback Statute and applicable antitrust laws.
  • Drafting and negotiating pricing agreements, supply agreements and/or value-based agreements with a focus on providing access to Amgen products to patients.
  • Advising key stakeholders on legal, regulatory and policy developments, as well as industry related government enforcement actions to ensure that legal support is adapted to a rapidly changing environment.
  • Counseling on pricing strategies, internal business reviews, financial forecasting and overall strategic business considerations.
  • Overseeing pricing agreement interpretation and contract enforcement, advising and managing commercial dispute resolution.
  • Supporting healthcare compliance related matters as they relate to implementation of pricing agreements and/or sales and marketing activities.
  • Developing and providing ongoing training to commercial operations staff regarding legal and regulatory requirements for commercial activity in the biopharmaceutical industry.
  • Helping Amgen shape external environment to improve patient access to its vital medicines.
  • Analyzing, reviewing and approving promotional, educational and support programs and materials and providing guidance on proposed sales and marketing strategies.
  • Coordinating legal support by contributing as a member of cross-functional team and interacting with business and law department colleagues on various matters.

What we expect of you

Basic Qualifications:

  • J.D. degree or LL.M. degree from an accredited law school, admission to practice law in a U.S. jurisdiction

and

  • two (2) years of experience practicing law

Preferred Qualifications:

  • 4+ years of corporate and/or law firm experience

  • Strong qualifications in transactional work in any industry, including structuring, advising and counseling on complex transactions and drafting, negotiating and interpreting complex contracts

  • Experience counseling clients on complex legal and regulatory considerations

  • Proven superior legal skills, including: excellent oral and written communication, legal analysis, drafting and negotiation skills and sound judgment

  • Ability to lead and influence others

  • Strong client service, business counseling and problem-solving focus

  • Ability to manage multi-dimensional projects in a fast-paced environment

  • Superior academic achievement

Experience in healthcare industry is a plus but not required, including counseling on:

  • Healthcare fraud and abuse matters

  • OIG compliance guidance and advisory opinions

  • DOJ settlements with pharmaceutical industry

  • Medicare/Medicaid reimbursement and contracting

  • Congressional hearings and inquiries

The expected annual salary range for this role in the U.S. (excluding Puerto Rico) is posted. Actual salary will vary based on several factors including but not limited to, relevant skills, experience, and qualifications.
