The mission of the Arizona State Board of Nursing is to protect and promote the welfare of public by ensuring that each person holding a nursing license or certificate is competent to practice safely. The Board fulfills its mission through the regulation of the practice of nursing and the approval of nursing education programs. The mission, derived from the Nursing Practice Act, supersedes the interest of any individual, the nursing profession, or any special interest group.

Job Summary:
Investigates complaints regarding alleged violations of the Nurse Practice Act. Investigates complex or sensitive allegations of legal or regulatory violations; interviews and collects evidence; examines and analyzes records and files; reviews and detects improprieties; determines and selects pertinent information and records for support of investigation; determines if a violation has occurred and recommends actions; researches and obtains investigative evidence and composes detailed investigative reports.
Prepares cases for administrative review/action, prepares consent agreements for use in administrative proceedings. Presents cases at Board Meetings and testifies in administrative hearings as official witness.
Job Duties:
• Investigates complaints regarding alleged violations of the Nurse Practice Act and apply knowledge throughout the investigatory process to determine violations and risks to public safety. Investigates complex or sensitive allegations of legal or regulatory violations; interviews and collects evidence; examines and analyzes records and files
• Extracts and analyzes information from statutes, legal documents, evaluations, healthcare and employment related records; interviewing and eliciting information in an investigation, and writing detailed investigatory reports with findings of fact, citation of suspected violation/s of the Nurse Practice Act, and disciplinary recommendation for Board action. Applies and interprets Federal, State and agency laws, rules, regulations, and policies regarding nursing practice and complex investigations. Applies and interprets civil, criminal, or regulatory laws of a complex nature
• Prepares cases for administrative review/action, prepares consent agreements for use in administrative proceedings. Presents cases at Board Meetings and testifies in administrative hearings as official witness. Work with applicable staff to refer criminal actions to appropriate law enforcement entities
• Prepares and issues subpoenas to obtain or inspect pertinent information (police reports, medical records, personnel records, etc.) and have information sent to the Board office. Prepares Interim Orders requesting licensees consider voluntarily participating based on prior actions taken by the Board, and thereafter, presenting to the board for final determination. Gathers, compiles, and preserves detailed evidence. Reviews and detects improprieties; determines and selects pertinent information and records for support of investigation; determines if a violation has occurred and recommends actions; researches and obtains investigative evidence and composes detailed investigative reports. Enters relevant case information and documents into the database to track and monitor open cases to ensure accurate status, and timely resolution of complaints

Knowledge, Skills & Abilities (KSAs):
Knowledge:
• Requires knowledge in the area of nursing practice, terminology, and meaning of the Nurse Practice Act
• Methods, techniques and principles for writing investigative reports
• Methods and techniques/principles for conducting investigations
Skills:
• Excellent written and oral communication skills, and the ability to objectively obtain and analyze information, knowledge, and applicability of the Nurse Practice Act
• Interpersonal relations, as applied to interaction with respondents, complainants, employers, other state boards of nursing
• Skills in extracting and using information from statutes, legal documents, evaluation forms, and related records
• Basic computer operations skills, including working with Word and Google documents
• Interviewing and eliciting information in an investigation
• Organization, prioritization, and follow through
Ability:
• Ability to work well with others; prioritize, plan, analyze, coordinate and manage a caseload
• Maintain objectivity; produce timely and accurate reports and documentation
• Presenting cases in a Board meeting or hearing
Selective Preference(s):
• Experience with investigations, substance abuse, social work, and or legal testifying preferred
Pre-Employment Requirements:
• Employees who drive on state business are subject to driver's license record checks, must maintain acceptable driving records and must complete any required driver training (see Arizona Administrative Code R2-10-207.12.)
• Requires possession of and ability to retain a current, valid state-issued driver's license appropriate to the assignment
