Position Overview
We are seeking a Patent Litigation Attorney to join a dynamic, technology-focused litigation team. The successful candidate will lead and support complex patent disputes in federal court and before the ITC, working with clients in high-technology sectors. This role combines deep knowledge of patent law and litigation strategy with technical fluency in areas such as computer science and electrical engineering, and requires courtroom experience and strong client-facing skills.
Key Responsibilities
- Manage all phases of patent litigation matters, including case assessment, strategy development, pleadings, motions practice, and trial preparation.
- Conduct legal research and draft high-quality briefs, motions, claim charts, infringement/noninfringement and invalidity contentions, and other litigation documents.
- Develop and execute discovery plans including written discovery, document review, e-discovery, and expert discovery.
- Work closely with technical experts and in-house or external patent counsel to analyze patents, prior art, claim construction, and infringement issues.
- Lead depositions of fact and expert witnesses; prepare witnesses and coordinate testimony strategy.
- Represent clients in hearings, settlement negotiations, mediations, and trials; present complex technical evidence clearly to judges and juries.
- Counsel clients on risk assessment, damages analysis, licensing, and settlement strategies specific to patent disputes and related IP matters.
- Collaborate with cross-functional teams, including patent prosecution, licensing, and business stakeholders, to align litigation strategy with commercial objectives.
- Mentor junior attorneys and supervise paralegals, contract attorneys, and outside counsel where appropriate.
- Stay current on developments in patent law, court decisions, PTAB practice, and technology trends relevant to clients inventions.
Qualifications
- Juris Doctor (JD) from an accredited law school and admission to the New York Bar (NY Bar) in good standing.
- 3+ years of patent litigation experience; trial experience and proven courtroom presence preferred.
- Technical degree (B.S./M.S.) in Computer Science, Electrical Engineering, or closely related discipline, or equivalent practical technical experience, highly preferred but not necessary
- Demonstrated experience with patent litigation fundamentals: claim construction, Markman briefs, infringement and invalidity analysis, and post-grant proceedings (e.g., IPRs, PGRs).
- Strong drafting, oral advocacy, and legal research skills with a track record of persuasive brief writing and motion practice.
- Experience managing complex e-discovery, document review platforms, and coordinating with technical teams and experts.
- Ability to explain complex technical concepts to non-technical audiences, including judges and juries.
- Excellent client management skills, judgment, and the ability to work both independently and collaboratively in a fast-paced environment.
- Mandarin fluency a plus, but not required.ย
