Job Description Summary

This position functions as Associate Counsel for MUSC Health’s community-based physician groups, and reports to the Associate General Counsel for MUSC Physicians. The primary focus of this position will be on provider contracting and provider clinic matters as well as collaborating on provider contracting practices, including but not limited to provider compensation, across the MUSC Health Enterprise. Additional responsibilities will include providing legal advice for corporate and general business matters, representing MUSC Health’s community physician groups in administrative proceedings, policy development and other areas of law as needs may arise.

Job Description

Prepares new and existing provider employment documents and reviews existing or proposed contracts and vendor arrangements. Using electronic contracts management system, reviews contracts in a timely fashion and provides advice as appropriate.  Drafts, negotiates and reviews legal document contracts, services, consultant and employment contracts in a timely fashion. 60%

Interprets or otherwise obtains interpretation of federal and state laws affecting  the MUSC Enterprise’s physician organizations; provides complex analysis of federal and state laws and regulations regarding health care related issues.  Demonstrates proficiency with state and federal laws including fraud and abuse laws and regulations, Medicare and Medicaid Conditions of Participation, coverage and reimbursement issues, HIPAA and privacy requirements, and state law rules and regulations; establishes a good working relationship with concerned agencies, including but not limited to South Carolina Department of Labor, Licensing and Regulation Boards.  30%

Participates in legal support services to MUSC Health’s community physician organizations, including but not limited to assisting management with provider issues and clinical care issues in physician clinics and participating in legal and/or administrative proceedings concerning MUSC Health’s community physicians.   Serves as an agent to accept, review and notify of employees of subpoenas, depositions and hearings. Coordinates depositions as needed and produces records and documents as required.  10%

Other duties as assigned. As a member of the MUSC Office of General Counsel, provide guidance on a wide range of legal and regulatory issues.

Additional Job Description

Required Qualifications:

  • Juris Doctor (J.D.) degree from an ABA-accredited law school.

  • Admission to practice law in the State of South Carolina (preferred), or eligible for admission within twelve (12) months.

  • Knowledge of federal and state laws, regulations, and codes pertaining to employment laws, rules and regulations.

  • Proficient in drafting, negotiating, and reviewing legal documents.

  • Excellent communication and interpersonal skills including the ability to be persuasive with other leaders across teams, positively influencing and supporting the mission of the organization.

  • Strong analytical and problem-solving skills.

  • Ability to work independently and collaboratively in a fast-paced, high-pressure environment.

  • High degree of client service, professional ethics, and integrity.

Preferred Qualifications:

  • 3-5 years of experience practicing law with a focus on provider contracting and compliance.

  • Experience in a higher education, healthcare, or government setting.
