SUMMARY

The Counsel position will partner with Legal and Asset Management teams to manage the company’s litigation, pre-suit claims, and provide legal support for asset management and operational issues in the seniors housing operating communities. We are looking for an energetic and intellectually curious professional who will proactively solve problems and develop strong relationships with our teams. This role requires excellent communication, organization, and initiative. The position can be based in any of our office locations.

KEY RESPONSIBILITIES

  • Manage the company’s litigation, including professional liability, general liability, and corporate litigation, as well as pre-suit claims.
  • Develop and execute proactive litigation strategy.
  • Work with our business partners, in-house teams, third-party claims administrator, and outside defense counsel on effective litigation management.
  • Review, edit, and approve all substantive pleadings, motions, and other filings.
  • Engage and manage outside defense counsel. Assist in developing claims prevention strategies.
  • Assist with settlement of claims.
  • Effectively collaborate with the company’s insurance carriers on claims management.

Create and streamline processes for discovery responses and operator management of cases

  • Utilize RMIS system for data analytics and loss prevention.
  • Create, oversee, and maintain the process for collecting, organizing, and analyzing all litigation data across our portfolio.
  • Provide consultation and advice to investment and asset management teams on day-to-day legal compliance issues in our portfolio.
  • Provide legal support and directed training on operational issues and disputes.
  • Develop and foster effective communication of current trends and regulatory changes among Welltower’s stakeholders, including internal team members as well as industry associations.
  • Provide general assistance with special projects as needed.

TRAVEL

Some out-of-area and overnight travel may be expected.

MINIMUM REQUIREMENTS

  • Law degree (J.D.) is required.
  • Admission in good standing to the Bar and licensed in any US jurisdiction is required.
  • 5+ years of experience as an attorney in insurance defense litigation and claims management. Experience with seniors housing litigation is preferred.
  • Experience handling insurance coverage issues and knowledge of insurance industry is strongly preferred.
  • Familiarity with Federal and State health care laws, licensing and other standards, Medicare and Medicaid programs, and data privacy regulations is preferred.
  • Proficiency with Microsoft Office suite, including intermediate excel skills.
  • Excellent written and oral communication skills.
  • Superior organizational, analytical, and interpersonal skills; Ability to work with diverse populations; Ability to work independently and as part of a team; Ability to handle multiple high priority tasks simultaneously.

Employment is contingent upon the successful completion of a background check, drug screening, and verification of employment, education, and other credentials relevant to the position.  

COMPENSATION 

Salaries may vary by location. The range for this role in New York is $145,000 - $195,000 plus bonus. Final compensation determinations are made based on a variety of factors, including, but not limited to, the candidate’s individual experience, education, and skill level; business strategic priorities; primary office location; scope and anticipated strategic impact of the role.
