Position Overview

Howard Law, P.A. is seeking an Associate Attorney – Foreclosure to join our growing creditors’ rights practice.

This is an excellent opportunity for a Florida-licensed attorney who wants to develop or expand their experience in foreclosure litigation and default servicing. The Associate Attorney will work closely with experienced attorneys, paralegals, and firm leadership while gaining hands-on responsibility for foreclosure matters throughout the litigation lifecycle.

The ideal candidate is organized, responsive, detail-oriented, and comfortable working in a deadline-driven, high-volume environment. Prior foreclosure or creditors’ rights experience is preferred, but we will consider candidates with strong litigation fundamentals and an interest in developing a practice in this area.

We are looking for an associate who takes ownership of their work and wants to grow into a strong foreclosure and creditors’ rights attorney. Successful candidates will be able to balance speed with accuracy, communicate effectively, and recognize when an issue requires escalation or additional legal analysis.

This position is well suited for an attorney who enjoys substantive legal work but also understands that successful default servicing requires disciplined file management, responsiveness, and consistent attention to client and court deadlines.

Responsibilities:
  • Manage and assist with a portfolio of Florida foreclosure matters from referral through final disposition under the guidance of senior attorneys and firm leadership.

  • Draft, review, and file complaints, motions, affidavits, proposed orders, discovery, and other pleadings required throughout the foreclosure process.

  • Conduct legal research and prepare memoranda regarding foreclosure, creditors’ rights, title, procedural, and litigation issues.

  • Prepare for and appear at hearings, case management conferences, mediations, summary judgment hearings, and other court proceedings.

  • Review borrower answers, affirmative defenses, discovery, and contested pleadings and assist in developing appropriate litigation strategies.

  • Communicate professionally with clients, opposing counsel, borrowers’ counsel, court personnel, and other parties involved in assigned matters.

  • Work closely with paralegals and support staff to ensure files progress accurately and within applicable court, client, investor, and servicer timelines.

  • Review title reports and assist with resolving title defects and other issues affecting foreclosure proceedings.

  • Assist with post-judgment and post-sale matters, including certificates of title, writs of possession, redemption issues, and related proceedings.

  • Maintain accurate file documentation and complete required attorney tasks within CaseAware and applicable client systems.

  • Assist with client reporting, escalated matters, quality-control reviews, and file audits.

  • Maintain compliance with applicable Florida law, court rules, federal servicing requirements, investor guidelines, and firm policies.

  • As experience develops, assume increased responsibility for contested foreclosure litigation and independent management of assigned files.

  • Assist with Georgia foreclosure matters where appropriate and based on licensure and experience.


Qualifications:Required
  • Juris Doctor (J.D.) from an accredited law school.

  • Active Florida Bar license in good standing.

  • Strong legal research, writing, analytical, and organizational skills.

  • Working knowledge of the Florida Rules of Civil Procedure.

  • Ability to manage multiple files, deadlines, and competing priorities in a high-volume practice.

  • Strong attention to detail and commitment to accurate, timely work.

  • Professional written and verbal communication skills.

  • Ability to work effectively with attorneys, paralegals, clients, and court personnel.

  • Comfortable learning and working within case-management and client-reporting systems.

Preferred
  • 3-5 years of experience in foreclosure, creditors’ rights, real estate litigation, civil litigation, or a related practice area.

  • Experience handling residential foreclosure matters in Florida.

  • Familiarity with foreclosure pleadings, summary judgment practice, mediations, and contested matters.

  • CaseAware experience.

  • Familiarity with LPS, ICE/MSP, or similar mortgage servicing platforms.

  • Experience working with mortgage servicers, institutional lenders, investors, or default servicing clients.

  • Knowledge of FNMA, FHLMC, FHA, VA, or private-label investor requirements.

  • Experience with title issues, post-judgment proceedings, writs of possession, or REO-related matters.

  • Georgia Bar admission or an interest in obtaining Georgia licensure is a plus.
