Legal & Risk Analyst

Hiring Range is $72,962 to $91,507annually based on qualifications, education and experience as it relates to the position.
Position Summary:
Under general direction of the Executive Director, provides legal examination by researching, analyzing, and investigating legal matters and drafting legal documents/contracts. Responsible for managing all property and liability insurance and the District's workers' compensation program, including identifying, evaluating, controlling and minimizing the District's exposure to loss or damage. Compiles and analyzes data to develop and recommend policies and administrative regulations. Performs duties in a manner consistent with the stated values of the organization.
Essential Duties:
Management/Leadership
  • Provides leadership in monitoring progress and providing feedback to ensure accountability for performance across the organization in the areas of legal/risk exposure.
  • Supervises, mentors and leads personnel. Plans and leads the daily operations and staff of the assigned areas with a strong focus on delivering effective services. Hires, instructs, and assists assigned staff in performing their daily duties and ensures timely processing of routine functions. Assigns work, tasks and projects, and provides back-up support as needed. Ensures compliance with applicable personnel guidelines and employment law. Performs annual performance reviews and recommends salary increases of assigned staff.
  • Demonstrates appropriate financial management relative to legal/risk area. Prepares, justifies, recommends and is administratively responsible for monitoring the assigned budget to be accountable to budget goals including interpreting and generating various financial reports. May prepare purchase orders, RFPs, journal transfers, and invoice requests. Audits outside counsel invoices to monitor total legal expenditures.
  • Performs long-range planning for legal/risk areas.
  • Coordinates legal/risk services and activities with other District areas, vendors and providers.
  • Provides reports, studies and recommendations to justify needs of the legal/risk area and to support decision-making.
  • Manages broad scope special legal/risk projects or initiatives of major concern or investment to the District.
  • Develops and maintains relationships with District employees, vendors, and providers.
  • Identifies, researches, and assists in the correction of legal/risk problems or issues.
  • Responds tactfully, respectfully and in a timely manner to inquiries and problems in person, through email, phone and mail by providing helpful information and explanations in-line with District policies and procedures. Thoughtfully handles confrontational or stressful interactions.

Risk Management/Workers' Compensation
  • Ensures property, liability, auto, and workers' compensation insurances are in force. Works with property/liability insurer on appropriate levels of insurance coverage.
  • Oversees the District's application for and use of Special Districts Association (SDA) safety grant funds.
  • Prepares insurance renewal application for the purpose of obtaining premium fees and updates on an ongoing basis. Negotiates with insurance companies, brokers, or agencies with respect to premiums, terms and conditions, renewals and modifications of insurance contracts.
  • Supervises the audit of insurance premiums, costs, and distribution of costs within the District.
  • Manages all liability, property, auto, and worker's compensation insurance and claims, including claims reviews; investigations and recommendations; and negotiations of settlements. Determines coverage, responsibility, compensability, and subrogation rights for each claim. Communicates with employees, insurance adjusters, and legal counsel.
  • Identifies exposures and assesses liability through evaluation of claim loss statistics and trends. Provides each department with loss statements for workers' compensation, general liability and auto losses.
  • Leads and coordinates all aspects of the District's Safety and Risk Management Programs and serves as the administrative advisor. Coordinates and monitors safety audits of District facilities.
  • Conducts risk assessments, which involves analyzing risks as well as identifying and estimating the risks affecting the District. Communicates potential risks to supervisors. Develops action plans designed to minimize risks/ the impact of risks by tracking the occurrence, determining response to the risk, and coordinating who will be responsible at each level.
  • Provides support, education and training to staff to build risk awareness within the District. Ensures appropriate safety and emergency management training is received by all staff, including NIMS certification training for appropriate staff. Oversees the Training Credit Program. Updates and maintains District Emergency and Crisis Management manuals and documents, including Incident and Accident forms.
  • Evaluates the impact of new and proposed legislation on the District's insurance and safety programs and makes recommendations for District compliance. Chairs the Steering and Audit Committees and is the Crisis and Emergency Preparedness Plan Coordinator.

Legal
  • Performs legal research on a wide variety of matters such as reviewing judicial opinions, tracking and checking statutory and regulatory provisions and quasi-judicial decisions, summarizing facts to provide pertinent information.
  • Manages relationship and serves as primary point of contact with District's legal counsel. Coordinates and discuss activities with District's legal counsel. Advises Department Directors on appropriateness of referring/escalating matters to legal counsel. Coordinates the delivery of legal services, tracks external legal assignments, and prepares comprehensive background materials to streamline attorney review.
  • Prepares a variety of legal documents and correspondence in final format.
  • Assists with property transactions and inclusions/exclusions
  • Drafts and reviews contracts entered into on behalf of the District for a variety of services including vendors, professional service agreements, etc. Identifies language of concern and offers alternative language when reviewing contracts drafted by other entities. Ensures compliance with statutory requirements, district policies, and risk management guidelines. Coordinates with internal departments and legal counsel to finalize legal terms and process contract amendments or change orders.
  • Serves as internal resource regarding statutory compliance issues for the District including annual statutory filings and actions.
  • Assists with various research, project work, and presentation development as needed.
  • Attends and participate in staff meetings, trainings and, orientations.
  • Attends and participates in professional group meetings; stays abreast of new trends and innovations in assigned areas.
  • Attends work on a regular, reliable and punctual basis.

Education and/or Experience:
  • Bachelor's degree in Paralegal, Risk Management or other related field.
  • Four (4) years of increasingly responsible professional experience in risk management, liability insurance (working in an insurance or legal office dealing with claims), workers' compensation, and/or background in litigation required.
  • Experience with legal research preferred.
  • Any combination of experience, training and education that demonstrates the required knowledge, skills and abilities to perform the essential functions of the position may be considered.

Licenses, Certifications, and Other Requirements:
  • Notary Public Certification or the ability to obtain upon hire.
  • Certified Risk Manager (CRM) designation preferred.
  • Certified Safety Manager (CSM) designation preferred.
  • Associate in Risk Management (ARM) certification preferred.
  • Paralegal certificate preferred.
  • Must possess a valid Colorado Driver License or the ability to obtain upon hire and maintain an acceptable driving record.

Necessary Knowledge, Skills and Abilities:
  • Thorough demonstrated knowledge of insurance terms, provisions, and coverages available; principles of claims management; subrogation claims; the immunities offered to governmental entities; computer software relative to insurance claim processing, the insurance field and general liability including review, investigation, and processing of a variety of types of claims; and current trends and legislation in risk management.
  • Trained and skilled in employment law and government regulations.
  • Must be highly motivated and take direction well.
  • Ability to work independently and with a team in a fast-paced and high volume environment with emphasis on accuracy and timeliness.
  • Excellent interpersonal skills with the ability to provide outstanding customer service, establish and maintain effective working relationships, and interact with others in a professional manner.
  • Strong proofreading skills, ensuring grammatical accuracy, and consistency;
  • Thorough knowledge of Microsoft Office applications, including Excel, Word and Outlook.
  • Thorough knowledge of Special Districts and local municipalities.
  • Solid organizational skills with excellent accuracy and attention to detail.
  • The ability to successfully analyze data, meet deadlines and provide accurate professional documents and complex reports under tight deadlines.
  • Ability to set priorities and make adjustments as needed to effectively manage multiple projects and organizational priorities.
  • Excellent communication skills to express facts, data, and ideas clearly and concisely both orally and in writing; build consensus with District personnel; and negotiate contract elements with consultants, vendors, providers and contractors.

Material and Equipment Used:
  • Uses standard office equipment including a desktop computer, 10-Key calculator, phone, printer, and photo copier.
  • This position may be required to drive a personal motor vehicle to various District and off site facilities.

Working Environment:
  • Works primarily in a clean, comfortable office environment subject to interruptions and background noise.
  • Occasionally travels to various work sites and remote locations in field environments with exposure to noise and other hazards.
