About the Role

We are looking for an experienced Director of Tax, Regulatory Affairs, and Treasury to join our team at our U.S. office in Pinellas Park, FL.

The Director of Tax, Regulatory Affairs, and Treasury is responsible for tax and regulatory reporting and compliance, serving as the corporate liaison for legal activities, and providing shared support in performing treasury functions. This position ensures tax and regulatory compliance for our domestic business operations and is responsible for the coordination and execution of all transfer pricing activities and functions. As the Director of Tax, all state license registrations will be completed, executed, and managed by this role. All tax returns will be reviewed and, when required, signed by the Director.

This role serves as a strategic business partner to the executive team and managers throughout the organization. Responsibilities include keeping stakeholders informed of changing tax and regulatory requirements, communicating the potential business impact of those changes, and establishing, implementing, and executing processes that ensure Davidoff of Geneva's ("Company") compliance obligations are met. Success in this role requires a deep understanding of the characteristics and categorization of tobacco products based on varying tax authority regulations and definitions.

This position requires excellent research, analytical, and organizational skills, as well as critical thinking, attention to detail, and strong presentation and communication abilities.

Tax Reporting and Compliance

State Sales and Tobacco Tax Licensing and Reporting

We are leading the way within our industry as a technology-enabled U.S. distributor, providing value through digitization, automation, and increased efficiencies. This is made possible by equipping employees and external business partners to succeed in a world where transactions are faster, more complex, and require a deeper level of sophistication.

Our B2B ERP system is SAP. We have customized RICEFs that provide our Tax Manager with the data required for state tobacco tax reporting and tobacco tax license management. The Director must be committed to developing deep expertise in state tobacco licensing regulations by analyzing requirements in the context of customer business models and our corporate structure. This knowledge is foundational to managing company licensing, customer licensing, and reporting requirements.

Our B2C e-commerce platform is BigCommerce. It includes IGEN, a cloud-based tax calculation system for multi-state tobacco and sales tax reporting. The Director is responsible for monitoring tax law developments by participating in a monthly call with industry associations, legal counsel, and consultants who monitor state excise tax collection, tobacco control regulations, licensing requirements, reporting obligations, and legislative developments that may impact the Model Legislation Project and related laws or regulations.

Our B2C brick-and-mortar retail ERP system is LS Retail. It includes Avalara/Evoort Solutions, a cloud-based tax calculation system for multi-state tobacco and sales tax reporting services. The Director serves as the primary contact for the vendor relationship and works closely with FP&A regarding master data management.

Corporate Income Tax

Maintain extensive knowledge of the corporate tax issues facing a multinational U.S. company, particularly in the areas of tax compliance and tax accounting.

Maintain the company's multi-state P.L. 86-272 election. Identify organizational changes that may create economic nexus, confirm implications with external tax consultants, and discuss filing decisions with the Head of Finance before implementation. Once approved, establish the appropriate economic factor for apportionment calculations.

Maintain the tax trial balance with an emphasis on transactions affecting the annual tax provision, return-to-provision differences, quarterly tax estimates, paid-in capital, and dividends. Annually, create the U.S. tax consolidation from year-end tax trial balances, including investment and equity roll-forward schedules. Provide the accounting team with journal entries to ensure accurate recording within the tax ledger.

Prepare the annual income tax provision workbook and manage year-end deliverables with FP&A and the accounting team, including sales by state, fixed asset roll-forward schedules, and related additions and retirements. Submit information to the external tax team for review. Upon completion of tax calculations, provide the accounting team with journal entries for both book and tax ledgers. Prepare and submit required information to the Swiss parent company's Tax Director.

Review Forms 1099 prepared by the accounting team for accuracy and appropriateness. Update Form 5472 schedules and transfer pricing information. Prepare the Section 263A UNICAP calculation for review by the external tax team.

Effectively manage the federal and state income tax return process, including annual filings and quarterly estimated payments, in collaboration with external advisors. Coordinate and manage tax audits as required. Maintain accumulated earnings and profits (E&P) schedules for dividend planning and analysis.

Regulatory Affairs Reporting and Compliance

The Company is a U.S. importer of tobacco products. Monthly reporting is required with two federal entities:

  • The Department of the Treasury's Alcohol and Tobacco Tax and Trade Bureau (TTB) using Form 5220.6 based on CBP Form 7501.
  • The Food and Drug Administration (FDA) using Form 3852, which serves as the basis for User Fee calculations.

This role is responsible for managing FDA User Fees and requires a strong understanding of tobacco regulations implemented under FDA authority since 2016.

Additionally, this position oversees the preparation and filing of the Department of Labor Form 5500 annual report to ensure compliance with ERISA requirements for employee benefit plans.

Corporate Liaison - Legal Activities

Handle confidential records and ensure corporate governance compliance by maintaining the contract repository for each U.S. corporate entity.

  • Board of Directors meeting minutes
  • Engagement letters
  • Secretary of State filings
  • Non-disclosure agreements (NDAs)
  • General Services Agreements (GSAs)
  • Statements of Work (SOWs)

This list is illustrative and not intended to be exhaustive.

Serve as the primary contact with external legal counsel and coordinate legal matters as required. Responsible for reviewing and approving monthly legal invoices.

Treasury Functions

As a Director within the Finance team, this role contributes to the enforcement of our dual-approval controls policy. All disbursements and the creation, modification, or activation of cash management templates require two independent authorized approvers with no conflicting duties. This control is designed to reduce fraud risk, strengthen segregation of duties, and ensure regulatory and audit compliance across treasury and accounts payable processes.

This role is also responsible for treasury management, including:

  • Cash forecasting
  • Cash management
  • Debt and financing activities
  • Investments
  • Banking relationships

To facilitate tax filing and payment activities through federal and state portals without dual approval, all payments must be supported by a filed tax return or sufficient documentation from an external tax consultant before submission.

All supporting documentation related to payments must be submitted to Accounts Payable within 24 hours and provided to the team member responsible for maintaining the daily bank sheet.

Requirements:

REQUIRED SKILLS AND KNOWLEDGE

· Proven skill in interpreting excise tax regulations and applying them to specific product attributes.

· Strong analytical and organizational skills. 

· Acute understanding of business process flows and related internal controls. 

· Intermediate working knowledge of Excel, utilizing tools like VLOOKUP and PivotTables.

SUPERVISORY RESPONSIBILITIES 

This position is responsible for the Tax Manager.    


EDUCATION and/or EXPERIENCE 

· Bachelor's degree in accounting with at least 5 years of experience in accounting / tax compliance within a public accounting firm and/or an international company.

· Minimum 10 years of experience with progressively increasing responsibilities.

· Strong knowledge of corporation income tax, ASC 740 accounting for income taxes, tax forecasting, and tax planning, with experience overseeing third-party tax preparation firms and ensuring timely, accurate tax compliance and financial reporting.

· Industry experience in premium cigar / popular price cigar industry or a similarly regulated industry is a plus.
