What is a claims attorney?

Claims Attorneys are legal professionals who specialize in handling claims, often within the insurance industry. Their primary responsibilities include reviewing, investigating, and resolving legal claims, such as insurance disputes, liability cases, or coverage issues. They provide legal advice to companies or clients, negotiate settlements, and may represent parties in court or arbitration when necessary. Claims Attorneys must possess strong analytical, negotiation, and communication skills to manage complex legal matters efficiently. Their work helps ensure that claims are handled fairly and in accordance with the law.

What does a claims attorney do?

The responsibilities of a claims attorney include working on cases involving insurance settlements and insurance law. Your duties in this career depend on where you work. You can work as a claims lawyer for an insurance company or a law firm that represents insurers or claimants. Your job is to represent the company or customer during the negotiation and settlement process and act as their attorney in court if needed. As a lawyer with expertise in insurance law and coverage, you may also represent a claimant who is seeking a payout from an insurance company.

What are the key skills and qualifications needed to thrive as a claims attorney, and why are they important?

To thrive as a Claims Attorney, you need a Juris Doctor (JD) degree, state bar admission, and a strong understanding of insurance law, litigation, and claims management. Familiarity with legal research tools like Westlaw or LexisNexis, case management software, and claims processing systems is typically required. Exceptional negotiation, analytical thinking, and written and verbal communication skills set top performers apart in this field. These skills and qualities are crucial for resolving claims efficiently, minimizing legal risk, and effectively representing clients or insurers.

How does a claims attorney typically collaborate with claims adjusters and other legal professionals during the claims process?

Claims Attorneys work closely with claims adjusters to evaluate the details of insurance claims and provide legal guidance on coverage, liability, and potential litigation. They often review documentation, assess legal risks, and advise on settlement strategies. In complex cases, Claims Attorneys may also coordinate with outside counsel, investigators, and experts to build a strong defense or support negotiations. Effective communication and teamwork are essential, as these collaborations ensure claims are resolved efficiently and in compliance with legal and company standards.

What is the difference between Claims Attorney vs Claims Adjuster?

AspectClaims AttorneyClaims Adjuster
Required CredentialsJuris Doctor (JD), State Bar LicenseHigh school diploma or equivalent; some roles require licensing or certifications
Work EnvironmentLegal offices, courts, insurance companiesInsurance companies, claims departments, field offices
