Will I be ok if I breathed in asbestos?

As an asbestos litigation attorney, understanding asbestos-related health risks is important. Breathing in asbestos fibers can cause serious health issues such as asbestosis, lung cancer, and mesothelioma, often developing years after exposure. If you suspect exposure, consulting a healthcare professional for evaluation and monitoring is recommended, especially if you experience respiratory symptoms.

Is it okay to live in a house with asbestos?

As an asbestos litigation attorney, it is important to know that living in a house with asbestos is generally safe if the asbestos-containing materials are intact and undisturbed. Risks arise if the materials are damaged or deteriorating, releasing fibers into the air, which can pose health hazards. Professional assessment and proper removal or encapsulation by certified asbestos abatement specialists are recommended to ensure safety.

What does asbestos do to humans?

Asbestos exposure can cause serious health problems, including lung diseases such as asbestosis, mesothelioma, and lung cancer. As an asbestos litigation attorney, understanding these health effects is crucial when evaluating cases related to occupational or environmental exposure, often involving medical evidence and expert testimony.

What are the key skills and qualifications needed to thrive as an Asbestos Litigation Attorney, and why are they important?

To thrive as an Asbestos Litigation Attorney, you need a Juris Doctor (JD) degree, state bar admission, and expertise in toxic torts, civil procedure, and personal injury law. Familiarity with legal research databases like LexisNexis or Westlaw, case management software, and e-discovery tools is typically required. Exceptional negotiation, analytical thinking, and communication skills are vital for building strong cases and effectively representing clients. These competencies ensure successful case preparation, effective advocacy, and favorable outcomes in complex asbestos-related lawsuits.

What is an Asbestos Litigation Attorney?

An Asbestos Litigation Attorney is a lawyer who specializes in representing individuals or groups affected by asbestos exposure, often due to occupational hazards, and who develop related illnesses like mesothelioma or asbestosis. These attorneys help clients seek compensation for medical expenses, lost wages, and other damages through lawsuits or settlements against manufacturers, employers, or other responsible parties. They are knowledgeable about federal and state asbestos regulations, the complexities of proving liability, and the procedures for filing claims. Their work often involves negotiating settlements or taking cases to trial on behalf of their clients. Because asbestos-related diseases can take years to develop, these attorneys are experienced in managing cases with complicated timelines and evidence requirements.

What are the most common challenges faced by an Asbestos Litigation Attorney during case preparation and trial?

As an Asbestos Litigation Attorney, one of the most common challenges is managing complex medical and technical evidence, often spanning decades. Attorneys must meticulously investigate clients' exposure histories and collaborate closely with medical experts, industrial hygienists, and other specialists to build a strong case. Additionally, coordinating with large legal teams and handling multiple cases simultaneously requires excellent organizational skills and attention to detail. Navigating evolving regulations and dealing with emotionally charged client situations are also frequent aspects of this role.

Where is asbestos found?

Asbestos is a naturally occurring mineral that was widely used in construction materials such as insulation, roofing, flooring, and fireproofing due to its heat resistance. It can be found in older buildings, industrial sites, and products manufactured before its health risks were well known. As an asbestos litigation attorney, understanding where asbestos is located helps in assessing exposure risks and legal cases related to asbestos-related illnesses.

Job description

Texas Attorney - Asbestos Litigation and Local Counsel
Our mid-size, Chicago-based insurance defense firm has an immediate opening for a Texas-based Attorney to handle asbestos litigation and serve as local counsel for key client matters. Admission to practice in Texas is required, with preference given to candidates also admitted to the Illinois or Missouri bar. This is a remote role focused on asbestos cases and serving as boots on the ground for Arch cases. Our firm's expertise spans toxic tort, complex product liability, general liability, and professional liability. We pride ourselves on a team-based approach to litigation, offering a level of customer service, flexibility, and responsiveness not often found in larger firms.
We are extremely flexible in terms of qualifications and background for this role, considering candidates who are of counsel with an existing book of business, part-time attorneys, or other experienced practitioners. The ideal candidate will have Texas asbestos litigation experience or, at a minimum, the ability to quickly learn and manage asbestos cases. Additional responsibilities include handling depositions and potentially more, depending on the candidate's experience and interest. This role is fully remote.
Position Overview: This is a hands-on role requiring strong case management skills, precision in legal writing, and professionalism in depositions and court hearings across multiple jurisdictions. Candidates must be hard-working, motivated, and capable of independent work. Ideal candidates will possess excellent analytical and critical reasoning skills, the ability to think strategically under pressure, and a client-focused mentality.
Primary Responsibilities:
• Take the lead in asbestos and complex litigation cases, handling all aspects of discovery, trial preparation, and strategy.
• Manage a high-profile caseload with autonomy and strategic oversight.
• Conduct depositions of plaintiffs, fact witnesses, and experts.
• Draft and argue motions, including dispositive and pretrial motions.
• Develop and execute trial strategy, working closely with our client and internal teams.
• Serve as local counsel, providing in-person support for key litigation matters.
• Train and mentor junior attorneys in litigation and trial tactics.
Candidate Requirements:
• Juris Doctor from an accredited law school.
• 8 - 12 years of litigation experience.
• Admitted to practice in Texas (secondary admission to Illinois or Missouri bar preferred).
• Experience with motion practice and depositions.
• Lead experience in plaintiff and expert depositions preferred.
• Capable of independent work.
• Highly organized and efficient.
• Superior research and writing skills.
• Ability to multi-task effectively.
• Strong analytical skills.
Compensation and Benefits Overview: $140,000-180,000 (DOE)
The pay offered for this role may vary based on factors such as job-related knowledge, skills, and experience. Eligible employees may also receive bonus opportunities and other forms of compensation, contributing to a comprehensive total rewards package. Benefits offerings may differ based on location.
In addition to monetary compensation, employees are provided with a robust selection of benefits, including:
• Comprehensive medical insurance plans (PPO and PPO HSA (with an HSA contribution up to $2000) provided by BCBSIL)
• Dental insurance plans (PPO provided by Guardian)
• Vision insurance plan (PPO provided by EyeMed)
• Access to a retirement savings plan (We match 100% of the first 3% of salary deferral plus 50% of the next 2% of salary deferral)
• Paid time off (PTO)
• Parental leave
• Commuter benefits
• Short-term and long-term disability coverage
• Accidental death coverage
• Other leave programs
Eligibility Requirements:
Participation in certain compensation programs and benefits is subject to specific eligibility criteria, which will be communicated during the hiring process.
Application Requirements: Please submit the following:
