Introduction

\r\nMaryland's\r\nFamily and Medical Leave Insurance (FAMLI) program makes sure all workers in\r\nMaryland have paid time off for medical and family reasons. FAMLI is a social\r\ninsurance system covering 2.6 million workers and 180,000 employers, delivered\r\nas a digitally native, public-facing service. We're in the early stages of\r\nbuilding something as big and as far-reaching as unemployment insurance or a\r\nnew health department. We know that delivering services primarily through a\r\nwebsite, over the Internet, is a new way of doing business in government.\r\nThe\r\nAppeals Unit is responsible for providing a fair and impartial process for\r\nreviewing\r\ndeterminations made by the\r\nFAMLI Division. Our Hearing Officers conduct hearings, review evidence, and issue legally sound\r\ndecisions while safeguarding due process. Main Purpose of Job

A Hearing Officer III FAMLI Lead/Advanced is the lead or advanced level of work\r\nconducting administrative hearings and preparing decisions in the FAMLI Appeals Division,\r\nMaryland Department of Labor. Employees performing the Lead level of work, assign, review\r\nand approve the work of and train lower-level Hearing Officers FAMLI. Employees\r\nperforming the Advanced level of work, are responsible for more complex cases.

POSITION DUTIES

\r\n\r\nDuties of this position\r\ninclude but are not limited to:\r\n\r\nHearing Officer III\r\n\r\n\r\n50% - Administrative Hearings &\r\nDecision Writing\r\n\r\nConducts\r\nimpartial administrative hearings related to the eligibility, benefits, and\r\ncontribution liability under the FAMLI program. Troubleshoots common, uncommon,\r\nand complex issues.\r\n\r\nReviews\r\nall pertinent facts surrounding the hearing.\r\n\r\nReviews\r\ncase materials, relevant statutes, and evidence prior to the hearing.\r\n\r\nFollows\r\nprescribed legal procedures and ensures that due process is maintained\r\nthroughout hearings.\r\n\r\nEvaluates\r\ntestimony and applies statutes, case law, and program regulations accurately.\r\n\r\nPrepares\r\ntimely, legally sound, and clearly written proposed decisions.\r\n\r\nCollaborates\r\neffectively with Clerks, administrators, and other team members in the Hearings\r\nUnit.\r\n\r\nEnsures\r\nconfidentiality and proper handling of sensitive information.\r\n\r\nRemains\r\nadaptable to new technologies and new processes as they are introduced.\r\n\r\nAssists\r\nwith appeals pre-review and intake to resolve and dispense of cases when\r\npossible.\r\n\r\nPerforms\r\nresearch in preparation for the administrative hearings.\r\n\r\nIssues\r\npre-hearing orders, subpoenas, administers oaths, examines witnesses and\r\nreceives documentary evidence.\r\n\r\nInstructs\r\nthe parties of their rights.\r\n\r\nConducts\r\npre-hearing conferences to limit issues, combine parties and representation,\r\naccept stipulations, determine order of presentation and to address other\r\naspects of the hearing.\r\n\r\n\r\n30% - Quality Assurance &\r\nTraining\r\n\r\nStays\r\nup to date on changes in administrative law, as well as FAMLI policies,\r\nprocedures and regulations.\r\n\r\nAssists\r\nin training new team members and training existing staff on changes in the law,\r\nregulations, and or appeals procedures.\r\n\r\nReviews\r\ndecisions written by more junior hearing officers for quality and accuracy\r\nbefore they are issued as final orders.\r\n\r\n\r\n15% Complex Case Adjudication\r\n\r\nConduct\r\nhearings for complex cases and make final decisions or recommendations on their\r\nresolution, ensuring compliance with relevant laws and policies.\r\n\r\n\r\n5% Other\r\n\r\n\r\nParticipates\r\nin trainings, team meetings and feedback sessions.\r\n\r\n Performs other duties as required.\r\n

MINIMUM QUALIFICATIONS

Education: A Juris Doctor degree or equivalent degree from an accredited law school. \r\nExperience: Four years of legal experience involving civil, criminal, or administrative proceedings. \r\nNotes: \r\n1. Candidates may substitute one year of experience administering paid leave programs for one year of the required experience. \r\n2. Candidates may substitute U.S. Armed Forces military service experience as a commissioned officer in judge advocate classification or judge advocate specialty codes in the general attorney field of work on a year-for-year basis for the required education. \r\n

DESIRED OR PREFERRED QUALIFICATIONS

\r\nDesired or Preferred Qualifications\r\nHearing Officer III Lead/Advanced:\r\n\r\n Experience supervising other hearing\r\nofficers is preferred.\r\n\r\n Experience in paid leave,\r\nunemployment insurance, workers compensation, or any other benefits\r\nadministration program is preferred.\r\n\r\n Experience standing up new government programs is preferred.\r\n \r\n\r\n \r\n\r\n\r\n

LICENSES, REGISTRATIONS AND CERTIFICATIONS

1. Candidates for positions in this classification must have membership in the Bar of any state or federal jurisdiction at the time of hire and must become a member of the Maryland Bar within 12 months of hire. \r\n2. Employees in this classification may be assigned duties which require the operation of a motor vehicle. Employees assigned such duties will be required to possess a motor vehicle operator's license valid in the State of Maryland. \r\n
