Plaintiff's Workers' Compensation Attorney (Remote)
Position Overview
We are seeking an experienced Plaintiff's Workers' Compensation Attorney to join our remote litigation team. The attorney will manage a caseload of workers' compensation matters from intake through resolution and appeals, advocating for injured workers in hearings, mediations, and trial. The ideal candidate combines strong trial and motion practice skills with thorough medical-legal knowledge, excellent client counseling, and efficient case management in a remote environment.
Key Responsibilities

  • Manage a full caseload of plaintiff workers' compensation claims from intake through resolution and appeals, maintaining client communication and expectations.
  • Conduct comprehensive legal research and prepare briefs, pleadings, motions, and memoranda using Westlaw/LexisNexis and internal resources.
  • Draft and respond to discovery, review and summarize medical records, and coordinate Independent Medical Examinations (IMEs).
  • Prepare for and take depositions; practice deposition strategy and witness preparation.
  • Handle motion practice and appear in WCAB/state workers' compensation hearings, case conferences, mediations, and trials as needed.
  • Negotiate settlements and coordinate lien resolution, Medicare/Medicaid coordination, subrogation, and other third-party claim issues.
  • Coordinate vocational rehabilitation assessments, damages calculation, and Social Security Disability referrals and hearing representation where applicable.
  • Manage evidence and exhibits, prepare trial notebooks, and present cases effectively in hearings and trials.
  • Use case management and legal practice software (e.g., Clio, MyCase, PracticePanther) to track deadlines, e-file documents, and maintain organized case files.
  • Communicate clearly and compassionately with clients, medical providers, adjusters, and opposing counsel; counsel clients on legal strategy and settlement options.
  • Collaborate with paralegals and support staff to delegate tasks, review work product, and ensure timely case progression.
  • Stay current on OSHA and workplace safety regulations, state WCAB procedures, and relevant statutory or regulatory changes affecting workers' compensation law.

Qualifications

  • Juris Doctor (JD) from an accredited law school and active bar admission in California.
  • Minimum 3+ years of hands-on plaintiff workers' compensation litigation experience; trial and hearing advocacy experience strongly preferred.
  • Proven experience with discovery, deposition practice, motion practice, trial preparation, and settlement negotiation.
  • Strong medical-legal literacy including medical records review, medical terminology, IME coordination, and experience with vocational rehabilitation matters.
  • Familiarity with WCAB/state workers' compensation procedures, Medicare/Medicaid coordination, lien resolution, and subrogation issues.
  • Experience with Social Security Disability claims and hearing representation is a plus.
  • Demonstrated legal research and writing skills; proficiency with Westlaw and/or LexisNexis.
  • Proficiency with legal practice management software (Clio, MyCase, PracticePanther), e-filing systems, and Microsoft Office (Word/Excel/Outlook).
  • Excellent oral advocacy and client counseling skills, with professional witness preparation and evidence management abilities.
  • Strong organizational and case management skills with the ability to prioritize, meet deadlines, and manage a remote practice independently.
  • Willingness to travel locally for hearings or depositions as required.
  • Ability to pass background checks and maintain client confidentiality; reliable remote work environment with stable internet connection.
