Job description

The National Director of HR Compliance will be responsible for ensuring compliance with HR laws and regulations at the federal and state levels. You will play a key role in developing and implementing robust compliance strategies, managing regulatory changes, supporting the Employment Practices Liability Insurance (EPLI) program and overseeing the company's unified position on HR compliance matters. The National Director of HR Compliance will work closely with internal stakeholders and client-facing HR teams to ensure internal service teams and clients adhere to all applicable employment laws and regulations.
Responsibilities:
  • Compliance Strategy Development: Develop and maintain a comprehensive understanding of HR compliance requirements at the federal and state levels. Formulate, inform and implement proactive compliance strategies to ensure Questco's adherence to all applicable laws and regulations.
  • Regulatory Monitoring: Monitor and analyze federal and state HR laws, regulations, and compliance requirements. Stay up-to-date and communicate changes in legislation, court rulings, and regulatory guidelines that may impact Questco and its clients. Provide timely updates and recommendations for company actions to internal stakeholders and local service center leaders.
  • Unified Position: Collaborate with key stakeholders, including the General Counsel, HR consultants, executive teams, and outside counsel, to develop and message Questco's unified legal position on HR compliance matters. Provide guidance based on legal interpretations and implications to align with the organization's objectives.
  • Compliance Program Management: Oversee the implementation and management of HR compliance programs. Ensure that policies, procedures, and practices are in line with legal requirements. Develop strategy and format to ensure regular audits are conducted to evaluate compliance effectiveness and identify areas for improvement.
  • Training and Education: Develop and deliver comprehensive training programs on HR compliance to client-facing HR teams. Educate and train employees on compliance procedures, policies, and best practices. Stay informed about emerging trends and changes in HR compliance and communicate them effectively to the HR teams.
  • EPLI Case Tracking and Management: Serve as the EPLI case tracking lead, maintaining a comprehensive and current log of all active and closed employment practices claims, charges, and demand letters. Ensure prompt notice to the EPLI carrier upon receipt of any claim, charge, or circumstance that may give rise to coverage, in strict accordance with policy reporting requirements. Track key case milestones including agency charge deadlines, response due dates and mediation dates and settlement discussions. Analyze EPLI claim trends to identify recurring issues, high-risk locations or departments, and root causes; present findings and recommendations to leadership.
  • Client Communication: Assist in the development and distribution of client communications regarding HR compliance updates, changes in laws and regulations, and interpretations/actions required. Ensure that communications are accurate, legally sound, and tailored to the specific needs of the client. Participate in direct client facing communication as needed.
  • Policy Development and Review: Collaborate with the HR team to review, revise, and develop company-wide HR policies and procedures to ensure compliance with relevant laws and regulations. Provide legal guidance on best practices and recommended actions to maintain compliance.
  • Risk Management: Identify potential areas of legal risk related to HR compliance and develop mitigation strategies. Collaborate with internal stakeholders to implement controls and monitor compliance processes, minimizing potential legal and financial liabilities for the Company as it relates to servicing the client base.
  • Workflow Management: Develop and implement efficient workflow processes and systems to facilitate the timely completion of HR compliance-related deliverables, projects, and communications. Collaborate with department leaders to ensure assignments are properly distributed and deadlines are met.
  • Employee Handbooks: Oversee the development, review, and updating of comprehensive Employee Handbooks that align with legal requirements and best practices. Collaborate with internal stakeholders and legal counsel to ensure accuracy, clarity, and consistency of policies.
  • Escalation Processes: Establish and maintain clear escalation processes for HR and employment-related issues, ensuring timely and appropriate resolution. Provide guidance and support to the team in handling complex and sensitive situations, fostering a culture of compliance and accountability.
  • Activity Tracking: Work with service directors to implement systems and tools to track HR compliance activities, including policy development, audits, investigations, policy reviews, and training completion. Generate reports and metrics to assess compliance effectiveness and identify areas for improvement.
  • Cross-Functional Collaboration: Collaborate closely with cross-functional teams, including payroll, HR operations, and client services, to ensure alignment on HR compliance initiatives and client deliverables. Foster strong working relationships and effective communication to drive successful outcomes.
  • People Management: Oversee and coach direct reports to maintain a culture of high performance and high reliability, driving accountability, accuracy and continuous improvement.
  • Completes with excellence other duties as assigned.

Qualifications:
  • Extensive experience (10+ years) in the HR field, with a strong focus on regulatory compliance.
  • 3+ years of experience in similar role within the Professional Employer Organization (PEO) industry strongly preferred
  • In-depth knowledge of federal and state HR laws and regulations, including but not limited to ADA, FMLA, FLSA, EEO, and Title VII.
  • Proven experience in formulating and implementing compliance strategies in a national context.
  • Strong understanding of HR policies, procedures, and best practices from a legal compliance perspective.
  • Excellent research, analytical and problem-solving skills, with keen attention to detail.
  • Outstanding written and verbal communication skills, with the ability to effectively communicate complex legal compliance concepts to diverse audiences.
  • Experience in managing relationships and collaborating on complex legal matters.
  • Ability to work independently, manage multiple priorities, and meet deadlines in a fast-paced environment.
  • Professional certifications in HR compliance (e.g., SHRM-SCP, SPHR) are highly desirable.
