The Law Collective is a Los Angeles-based personal injury law firm founded by two brothers, with offices throughout California and Nevada. The firm represents accident victims on a contingency fee basis across practice areas including car accidents, Uber/Lyft accidents, workers' compensation, wrongful death, and catastrophic injury, with a track record of multimillion-dollar settlements and verdicts. The Law Collective's teams are bilingual (Spanish/English) to serve clients across its markets.
Job Summary
The Pre-Litigation Attorney is responsible for overseeing the negotiation phase of cases - from opening the claim with the insurance carrier through reaching a settlement, without the need to go to trial. This role supervises the assigned Case Managers, reviews and approves their work, and negotiates directly with insurance adjusters to secure the best possible outcome for clients. When a case cannot be resolved at this stage, the Pre-Litigation Attorney participates in the handoff to litigation.
Key Responsibilities
  • Oversee and manage a caseload in the pre-litigation phase, supported by assigned Case Managers
  • Review and approve Case Managers' work (demand letters, medical records, liability documentation)
  • Negotiate directly with insurance adjusters and/or attorneys to reach favorable settlements for clients
  • Assess the legal viability and value of each case (liability, injuries, insurance coverage)
  • Determine when a case should escalate to the litigation team
  • Meet with clients when needed to resolve complex legal matters
  • Provide day-to-day guidance and direction to the Case Manager team

Requirements
  • Juris Doctor (JD) and active license to practice
  • Approximately 3 years of experience in litigation or pre-litigation (personal injury)
  • Experience negotiating directly with insurance carriers/adjusters
  • Ability to manage a high caseload simultaneously
  • Leadership skills to supervise and direct the Case Manager team
  • Bilingual Spanish/English (preferred but not required)

Desired Skills (preferred, not required)
  • Previous experience as a supervisor or team lead
  • Experience with depositions or drafting legal pleadings
