What does an OSHA attorney do?
An OSHA Attorney specializes in workplace safety laws and regulations under the Occupational Safety and Health Act. They assist businesses in compliance matters, represent clients during OSHA inspections, and defend against citations or penalties. OSHA Attorneys may also represent employees in cases involving workplace safety violations or retaliation claims. Their role includes advising on risk management, handling negotiations, and litigating OSHA-related disputes.
What skills and qualifications are needed to thrive as an OSHA attorney?
To thrive as an OSHA Attorney, you need a strong understanding of occupational safety and health law, litigation experience, and a Juris Doctor (JD) degree with active bar admission. Familiarity with legal research databases such as Westlaw or LexisNexis and relevant OSHA regulations is crucial, and certification in labor or employment law can be beneficial. Exceptional analytical thinking, negotiation, and clear communication skills are valuable in advising clients and representing them before regulatory agencies. These abilities ensure effective legal representation, compliance advocacy, and successful resolution of complex workplace safety matters.
What kinds of cases or legal matters do OSHA attorneys typically handle?
OSHA Attorneys generally advise employers or employees on compliance with Occupational Safety and Health Administration (OSHA) standards, represent clients during OSHA inspections, and handle disputes arising from workplace safety violations. Their work can include conducting internal investigations, responding to citations, defending clients during agency hearings, and negotiating settlements. They may also provide training and preventative counseling to organizations to reduce legal risks. In this role, attorneys often collaborate closely with HR professionals, safety managers, and regulatory agencies to ensure safe and legally compliant workplaces.

Job description
Williams Parker, the region's largest and oldest law firm founded in 1925, is seeking an accomplished Senior Labor & Employment Attorney with approximately 10-15 years of private practice experience and a portable book of business to join our growing Labor & Employment practice.
This opportunity is ideally suited for an attorney located along Florida's Gulf Coast corridor-from North Tampa through St. Petersburg, Clearwater, Bradenton, Sarasota, Venice, Osprey, and North Port-who is looking to expand a sophisticated employer-side practice within a collegial, highly respected law firm platform.
The successful candidate will play a significant role in strengthening the depth and execution capacity of our Labor & Employment section while helping employers navigate increasingly complex workplace challenges.
What You Will DoAs a trusted advisor to employers across diverse industries, you will:
- Counsel employers on complex workplace issues, workforce strategy, risk management, compliance, and employment-related litigation.
- Conduct and oversee sensitive workplace investigations involving allegations of discrimination, harassment, retaliation, misconduct, and other employment concerns.
- Represent clients in federal and state courts and before administrative agencies, including the EEOC, NLRB, Department of Labor, OSHA, and related regulatory bodies.
- Provide practical and business-oriented guidance on hiring, discipline, accommodations, wage and hour compliance, reductions in force, separations, restrictive covenants, and employee relations matters.
- Draft, review, and implement employment agreements, executive agreements, separation agreements, handbooks, policies, and workplace procedures.
- Deliver management training, employment audits, compliance reviews, and proactive risk-assessment programs designed to reduce litigation exposure.
- Advise employers on emerging workforce issues involving immigration-related employment compliance and workforce mobility, either directly or in collaboration with specialized immigration counsel.
- Identify and coordinate ERISA-related considerations that arise within broader employment matters while working alongside specialized benefits counsel when appropriate.
- Advise employers and insurance carriers on Employment Practices Liability Insurance (EPLI) matters, including pre-litigation strategy, claim management, and defense coordination.
- Develop and expand client relationships while contributing to the continued growth of the Labor & Employment practice.
- Mentor and collaborate with junior attorneys and professional staff to enhance service delivery and practice development.

- Florida Bar Board Certification in Labor & Employment Law is preferred.
- Approximately 10-15 years of employer-side labor and employment experience in a law firm environment, including a demonstrated record of providing strategic counsel and representing employers in litigation, arbitration, class and collective actions, and administrative proceedings.
- Significant experience advising employers on complex workplace matters involving employee relations, workplace investigations, EPLI claims, wage and hour compliance, accommodations, leave management, labor relations, restrictive covenants, workforce restructuring, and executive employment issues.
- Experience representing employers before federal and state courts and administrative agencies, including the EEOC, NLRB, Department of Labor, OSHA, and related regulatory bodies.
- Experience counseling and defending employers in matters arising under federal and state employment laws, such as Title VII, ADA, ADEA, FMLA, FLSA, OSHA, whistleblower, affirmative action, and related employment law frameworks.
- Experience drafting and advising on employment agreements, separation agreements, employee handbooks, workplace policies, training programs, and human resources compliance initiatives.
- Familiarity with employee benefits, ERISA-related issues, immigration-related employment matters, workforce mobility, and employment eligibility compliance is preferred.
- Experience managing complex discovery matters, including e-discovery, is beneficial.
- Portable book of business and demonstrated business development capability required.
- Ability to serve as a trusted advisor to business owners, executives, human resources leaders, and in-house counsel.
- Strong communication skills with the ability to translate complex legal issues into practical business advice.
- Proven ability to independently manage multiple high-level matters while maintaining exceptional client service.
- Collaborative leadership style with an interest in mentoring and developing future talent within the practice.
