As a legislative attorney, your job is to support a legislative body as they prepare reports, documents, and proposed materials. In this role, you may help determine whether or not a proposed bill complies with existing law and suggest solutions for any issues. You also ensure that the legislators follow the correct procedures throughout the process of creating laws. The Flandreau Santee Sioux Tribe (the “Tribe”), located in Flandreau, South Dakota, is seeking applicants for the full-time position of Deputy Attorney General. The Deputy Attorney General, under the direction of the Tribe’s Attorney General, is responsible for providing legal services and representation to the Tribe’s Executive Committee, its subcommittees, departments, and tribal entities, providing guidance and assistance as assigned. The Deputy Attorney General will primarily assist the Attorney General with matters regarding the representation of the Tribe, including its Land Committee, Per Capita Committee, Tribal Health, Housing, Tribal Historic Preservation Office, Natural Resources, tribal businesses, and others as assigned. This position will further be tasked with assisting with matters of internal policy development and tribal code revision.
ESSENTIAL DUTIES AND RESPONSIBILITIES include, but are not limited to:
The Deputy Attorney General shall perform legal services as requested by the Tribe as Deputy Attorney General General. The duties required of the Deputy Attorney General shall be subject to the supervision and direction of the Attorney General.
The Deputy Attorney General shall only act on such matters as specifically aimed at acting upon either by resolution or formal direction of the Executive Committee. Said legal services shall include attendance at meetings, advice on legal and policy matters, assertion of any valid claims through appropriate legal proceedings, preparation and review of legal documents, assistance in negotiation, preparation and execution of any settlement agreements, representation before appropriate agencies, tribunals, and legislative bodies, and other legal matters as may be specified by the Executive Committee.
The Deputy Attorney General will provide a broad range of legal services, including, but not limited to, tribal governance, tribal law, administrative law, employment law, tribal jurisdiction, health law, contract law, and other areas to meet the needs of the Tribe.
The Deputy Attorney General will be responsible for advising tribal government departments, programs, committees, commissions, and other regulatory bodies as assigned.
The Deputy Attorney General will draft and review legal documents, including but not limited to, Tribal Ordinances, leases, policies and procedures, letters, contracts, Tribal Resolutions, and legal briefs.
The Deputy Attorney General will be responsible for ensuring that tribal businesses comply with applicable tribal, state, and federal laws as assigned.
The Deputy Attorney General General will be tasked with drafting legal memos, pleadings, and other correspondence as required by the Tribe and/or as assigned.
The Deputy Attorney General General will be required to identify, research, review, and advise on legal issues impacting the Tribe, its departments, programs, and businesses.
The Deputy Attorney General General will be required, from time to time, to work independently under the supervision of the Attorney General.
Regularly present updates to the Attorney General, and provide updates to the Executive Committee as requested.
QUALIFICATIONS, EDUCATION AND/OR EXPERIENCE:
• Licensed attorney in good standing with the State Bar of South Dakota, or any other state bar, and is able to be admitted in South Dakota within three (3) months of employment.
• Must have three (3) years of experience as a practicing attorney, with experience in Indian Law, Tribal Administration, Tribal Health, and/or Tribal Housing preferred.
• Must not have been terminated for cause from any position with Tribe within the past three (3) years.
• Must have a juris doctorate from an American Bar Association-accredited law school.
• No felony or misdemeanor convictions involving a crime of moral turpitude.
• Must be available for full-time in-office work.
• Must be able to efficiently utilize Microsoft Office and Westlaw.
• Must have a valid driver’s license.
