What is an intellectual property manager?
What is the difference between Intellectual Property Manager vs Patent Agent?
| Aspect | Intellectual Property Manager | Patent Agent |
|---|---|---|
| Credentials | Typically requires a law degree and IP certifications | Requires a technical degree and patent bar admission |
| Work Environment | Manages IP portfolios, oversees legal strategies, collaborates with legal teams | Drafts, files, and prosecutes patent applications, often working closely with inventors |
| Employer & Industry Usage | Common in corporations, law firms, and IP agencies | Primarily in law firms, corporate legal departments, and patent offices |
| Search & Comparison Intent | High overlap in IP management and legal expertise | Focuses more on patent prosecution and technical evaluation |
The main difference is that an Intellectual Property Manager oversees the broader IP strategy and portfolio management, often with legal oversight, while a Patent Agent specializes in drafting and prosecuting patent applications, usually with technical expertise and patent law certification.
What Is an Intellectual Property Manager?
An intellectual property (IP) manager is an analyst who manages intellectual property assets for a business or institution. You must have expertise in patent law and other forms of intellectual property protection. As an intellectual property manager, your responsibilities include examining existing patents and protections, expanding and updating policies, investigating infringements on patents, and ensuring the protection of your employer’s intellectual property. This protection is especially crucial during technology transfers. In addition to management duties, you may also serve as an advisor to your company, researching existing patents they can buy to avoid research and development costs.

Our Technology & Intellectual Property Team
Stoel Rives' Technology & Intellectual Property practice is a multidisciplinary group that includes attorneys with experience in business, regulatory law, and litigation related to intellectual property rights (patents, copyrights, trademarks, and trade secrets). Our patent litigation team mobilizes technical and scientific knowledge, business understanding and courtroom experience. Our attorneys have handled hundreds of patent litigations in courts throughout the United States, including in those jurisdictions known for speedy depositions and expedited paths to trial.
Responsibilities

Support day-to-day management of trademark and copyright litigation.
Draft motions and briefs, including discovery motions, claim construction (Markman) briefing, Daubert motions, and dispositive motions, with opportunities to argue in court as appropriate.
Take and defend depositions of fact witnesses and assist in preparing inventors, experts, and corporate representatives for testimony.
Assist with fact and expert discovery, including document review, ESI protocols, drafting protective orders, and coordination with vendors.
Contribute to infringement and invalidity analyses; assist with preparation and refinement of contentions and collaborate with technical and damages experts.
Support trial preparation, including drafting witness outlines, preparing exhibits, assisting with motions in limine and jury instructions, and providing in-court support.
Assist with claim construction efforts, including researching key terms, analyzing intrinsic and extrinsic evidence, and drafting portions of briefing.
Work with experts on damages analyses and support broader case strategy, including settlement discussions.
Communicate effectively with internal teams and contribute to client reporting and case strategy discussions.
Collaborate with partners, senior associates, and professional staff; provide guidance to junior team members and contribute to a positive team environment.
Qualifications
JD from an accredited law school with strong academic credentials.
3-5 years of intellectual property litigation experience at an AmLaw 200 firm or leading IP boutique.
Experience with key phases of intellectual property litigation, including pleadings, discovery, depositions, expert discovery, claim construction, dispositive motions, and trial preparation.
Experience drafting substantive motions and briefs; deposition and oral advocacy experience preferred.
Technical background (e.g., electrical engineering, computer science, mechanical engineering, physics, biology, chemistry) preferred; USPTO registration a plus.
Experience with PTAB IPRs and/or ITC Section 337 investigations is a plus.
Experience with TTAB oppositions, cancellations, and/or appeals is a plus.
Experience with UDPR complaints is a plus.
Familiarity with FRCP, FRE, patent local rules, and e-discovery tools/practices.
Strong legal writing, research, and analytical skills, with attention to detail and sound judgment.
Strong organizational skills and ability to manage multiple assignments and deadlines in a fast-paced environment.
