Flynn Group (together with its subsidiaries Apple American Group, Bell American Group, Pan American Group, RB American Group, Hut American Group, Wend American Group, and Flynn Fitness Group) seeks a collaborative and business-minded Counsel, Litigation to join its industry-recognized legal team. Flynn is unique for its accomplished in-house litigation practice, which handles first-hand many of its own litigation and arbitration matters, in addition to overseeing outside counsel. If you’re a trial lawyer at heart and are excited about supporting some of the most iconic and beloved restaurant brands in the nation—including Applebee’s, Taco Bell, Panera, Arby’s, Wendy’s, Pizza Hut, Planet Fitness, and 7Brew—this is the role for you.

Role Description

This attorney will support senior members of the Litigation team, collaborate with outside counsel and business leaders, and help manage a diverse litigation portfolio while providing practical, solution-oriented legal advice that supports the Company’s operational goals. Reporting to the Associate General Counsel, Litigation, you will help oversee litigation matters in California and non-California jurisdictions through close coordination with senior attorneys and outside counsel. Your focus will include premises liability, general liability, commercial disputes, and significant pre-litigation matters, with additional experience in auto liability, transportation, real estate, construction, ADA Title III, privacy, or regulatory investigations a plus.

Responsibilities

  • Litigate! Support senior members of the Litigation team with in-house management of pre-litigation claims, lawsuits, arbitrations, and other disputes, including coordinating matter strategy, status, deadlines, and resolution planning.
  • Individually oversee outside counsel on assigned matters, including developing and aligning on case strategy, evaluating budgets, reviewing legal work product, monitoring performance, and ensuring efficient, cost-effective representation.
  • Evaluate liability, damages, litigation risk, and settlement opportunities, and provide practical recommendations that balance legal risk with business objectives.
  • Review pleadings, discovery, dispositive motions, mediation statements, settlement agreements, and trial strategy prepared by outside counsel, and provide input to senior attorneys and outside counsel on litigation strategy and case development.
  • Prepare corporate representatives and witnesses for depositions, mediations, and trial.
  • Coordinate litigation holds, document preservation efforts, discovery responses, subpoenas, and government inquiries.
  • Manage and conduct internal investigations and provide day-to-day legal advice to operational stakeholders.
  • Stay current on relevant industry and litigation-related laws and travel as needed.

Qualifications

  • 3+ years of litigation experience.
  • Juris Doctor from an ABA-accredited law school; California Bar admission in good standing (bar admission in additional states a plus!)
  • Experience supporting civil litigation through discovery, mediation, trial preparation, arbitration, or trial, whether as part of a litigation team, in-house legal department, or outside counsel team.
  • Excellent legal writing, analytical, negotiation, and communication skills, including the ability to communicate clearly with attorneys and non-lawyers.
  • Strong organizational skills with the ability to manage numerous matters, shifting priorities, and competing deadlines simultaneously.
  • Sound judgment, practical business orientation, and the ability to provide clear recommendations in a fast-paced environment.
  • Strong ownership, excellent client service orientation, and the judgment to work independently on assigned responsibilities while collaborating closely with senior attorneys and escalating issues when appropriate.
  • Ability to collaborate effectively with legal staff, outside counsel, and business clients across departments.
  • Preferred experience in premises liability, general liability, hospitality, restaurant, retail, transportation, ADA accessibility, or other high-volume litigation environments.
  • Preferred experience managing outside counsel, litigation budgets, e-billing, matter management systems, legal technology, or AI tools that improve efficiency.
  • A sense of humor, an upbeat can-do attitude in keeping with the company’s “Own It!” philosophy, and a genuine enthusiasm for practicing law.

California Based Candidates: The good faith estimated range of pay for the above position is $150,000 - $180,000 depending on factors including but not limited to experience and skill. There is a target discretionary incentive bonus of 20%.
