Cancellation Policy: A. Cancellation for Cause. If Customer concludes, in its sole discretion, that any Contract Workers provided by Supplier have engaged in misconduct, or have been negligent, Customer may require the Contract Workers to leave the premises and will notify SWA immediately, in writing, providing reasonable detail the reasons for such dismissal. Customer's obligation to compensate SWA for such Contract Worker's services will be limited to the number of hours actually worked. SWA will not reassign the individual to customer without prior approval of the Customer.

B. Pre-Start Cancellation. Customer may without charge cancel any Order for Contract Worker assignment at any time prior to the commencement of the assignment.

C. Assignment Cancellation for Convenience. Customer agrees to utilize Contract Workers for the specified period of time, outlined in the Work Orders. Should Customer's staffing needs change and Customer wishes to cancel Contract Worker already being utilized on an assignment, Customer will notify SWA of the forthcoming cancellation and SWA will give Supplier ten (10) days' notice before cancellation date. If Customer does not provide required notice, Customer will be required to pay SWA a fee equal to: the lessor of the sum of seventy-two (72) hours of such Contract Worker's bill rate subtracted by any hours worked by Contract Worker after notice is given (Calculated as Bill Rate x 72 Hours – Hours Worked after cancellation notice) or the number of scheduled hours within the ten (10) day notice period.

D. Shift Cancellation. Supplier acknowledges that Customer may cancel two (2) shifts per four (4) week period without penalty, with a minimum of two (2) hours' notice to SWA.

E. Per Diem Order Cancellation. If Customer changes or cancels an order less than two (2) hours prior to the start of a shift, SWA will bill the Customer, on the behalf of the Supplier, for four (4) hours at the established fee for each scheduled Contract Worker. SWA will be responsible for contacting Staffing Supplier prior to Contract Worker reporting time.
