Job description

Summary:
Senior Counsel works as an in-house contracts attorney dealing with contracts, laws and regulations that relate to the health care field.
Job Duties & Responsibilities:
As an In-House Counsel you can expect your daily duties to include:
  • Provide practical and wide-ranging advice on legal issues; review contracts/renewals related to physicians, suppliers, and independent contractors and other.
  • Conduct Legal Research into a variety of healthcare and business-related issues.
  • Providing accurate, relevant and timely advice to your employer and other members of staff on a variety of legal topics that relate to the business sector and their products or services.
  • Drafting, reviewing and negotiating various commercial contracts and agreements.
  • Managing and mitigating legal risks by designing and implementing company policies and procedures.
  • Ensuring compliance with all laws and regulations that apply to the business.
  • Promoting legal, compliance and risk management best practice throughout the company.
  • Communicating with and managing any third-party bodies such as external counsel or auditors.
  • Designing and delivering legal training to the business.
  • Staying up to date with changes to legislation, particularly in relation to laws, rules and regulations that directly affect your business and specific industry.
  • Liaising with senior members of staff.
  • Assist in the management of outside counsel on litigation or risk related matters.
  • Coordinating with Regulatory Department on compliance initiatives throughout the organization.

Assist in promoting a team atmosphere by treating individuals with respect and honesty and by using direct communication and active listening skills.
  • Be open to change and actively support change.
  • Be open to others' ideas and points of view.

Promote department goals as well as the mission of Rogers Behavioral Health.

Oversee work of junior attorneys or paralegal staff within the department.
Participate in in-services, seminars, and other meetings as assigned to increase involvement and awareness of Joint Commission and other regulatory agency compliance regulations.
Participate in committees, Rogers Operating System (ROS) team meetings, and team projects, as directed.

  • Communicate concerns and provide solutions for same.
  • Attend outside seminars and/or educational classes to promote professional growth and meet continuing education requirements.
  • Demonstrate a positive and professional attitude toward parties outside Rogers Behavioral Health ((i.e. academic partners, professional guest speakers etc.).
  • Comply with Rogers Memorial Hospital policies and procedures, including Human Resources, Infection Control, and Employee Health policies and programs.
  • Project a professional image by wearing appropriate, professional attire as defined in Rogers Memorial Hospital policy.

Additional Job Description:
Physical/Mental Demands:
  • Position requires walking, sitting and standing. Lifting is moderate; must be capable of lifting a minimum of forty (40) pounds. Reaching, handling, grasping and manual dexterity are necessary to operate various equipment.
  • Verbal and hearing ability are required to interact with staff, consultants, patients and family members of patients. Numerical ability is required to maintain records and operate a computer.
  • Tact is required to interact effectively with employees and professional staff. Logical thinking and discretion required to make decisions in initiating and implementing policies and procedures and standards.
  • Must be able to read and communicate through written, verbal and auditory skills and abilities.
  • Must be physically/mentally able to perform job duties as verified by a physical exam by a licensed physician, per post-employment physical.

Education/Training Requirements:
  • Bachelor's Degree and a Juris Doctorate Degree required.
  • Current state license
  • 7 to 10 years of healthcare law experience, including physician contracting experience.
  • Must have superior academic credentials and 3+ years of corporate, regulatory or transactional experience in a law firm setting, including representation of healthcare organizations.
  • Solid knowledge of HIPAA, Affordable Care Act, Medicare, Medicaid, Stark law, False Claims Act, and Federal Anti-Kickback Statue is needed.
