Job Summary:

Position is responsible for drafting and developing administrative rules; five-year review reports (5YRR), substantive policy statements (SPS) and guidance documents (GD) for the agency. This position performs duties of considerable difficulty in conducting legal research on issues having a major impact on the agency and developing, drafting, reviewing, editing, filing, finalizing, and maintaining the agency's administrative rules and regulatory agenda.

Job Duties:

Responsibilities include:
Responsible for ADHS rulemaking activities, including, drafting: rules economic impact statements (EIS), 5YRRs, SPSs, and GDs that comply with the Arizona Administrative Procedure Act (APA). Facilitate the creation, amendment, and termination of ADHS' administrative rules through the statutorily mandated rule-making process, including, but not limited to: drafting Moratorium exception requests, docket openings, and all rules-related notifications pursuant to the APA; meet with internal and external stakeholders, members of the public, Department personnel and public groups or bodies in order to assist with drafting rules, EISs, 5YRRs, SPSs, and GDs; solicit public comments, conduct public hearings, and schedule/facilitate all proceedings regarding proposed agency rules; adequately address all concerns or issues received by ADHS in writing or at a public hearing in relation to ADHS' rules or rulemaking activities; revise the rule(s) as major issues are discovered; prepare and submit to the Governor's Regulatory Review Council (GRRC) a variety of reports relating to the effectiveness of the agency's administrative rules, rulemaking progress and levels of compliance; represent the agency in proceedings of the GRRC.
Provide technical expertise, guidance, training & assistance regarding the administrative rulemaking process and the agency's continuous obligation to review and maintain the agency's rules.
Gather and understand the program-specific technical data and information needed to develop, write, maintain, support, and defend ADHS' administrative rules, EISs, 5YRRs, SPSs, and GDs.
Research and analyze current and pending legal and other issues related to ADHS' rules and regulatory activities, including, but not limited to: proposed, current, and historical statutory authority; rules and regulations of other states; and, Department SPSs, GDs, policies, procedures, and best practices.
Complete special assignments and research projects for executive staff, including proposing, drafting reviewing, analyzing, monitoring and implementing legislation.
Other duties as assigned as related to the position.

Knowledge, Skills & Abilities (KSAs):

Legal research methods and application of legal principles.
State and federal statues, rules, regulations, policies and procedures.
Rule drafting principles.
State rule-making process and substantive policy process.
Regulatory functions of public health, areas served and constituent needs.

Computer programs and tracking systems.
Performance Management (PM), and Continuous Quality Improvement (CQI) and Lean methodologies.
Skilled in:
Research, analyze and interpret Department issues.
Develop written materials.
Write in a clear, concise and understandable manner.
Effectively communicate with Department personnel and the public.
Evaluate the work procedures of Department personnel.
Maintain effective interpersonal skills.
Operate a Windows-based computer and various software applications.

Organize complex information and present it in an understandable and concise format.

Selective Preference(s):

Bachelor's degree in Pre-Law, Business, Political Science or a related field with four (4) years professional experience in law, government, legislation, policy and/or regulator issues OR four (4) years of work experience may substitute for educational preferences.

Retirement:

To help you build a financially secure future, the State makes monthly contributions to finance your retirement benefit. The State will contribute to the ASRS in an amount equal to your contribution. In other words, you and the State will each pay 50% of total cost of the benefit. New State employees have a 27-week wait period for contributions to begin.
