Responsibilities

The Claims Consultant handles high-exposure transportation claims (trucking, public transit, rail) throughout the United States.

Key Functionsย will include but not be limited to:

  • Determine whether Gemini has a present or potential future defense obligation or indemnity obligation on assigned claims and position claims accordingly.
  • Handle assigned claims for which Gemini has a present or potential future defense obligation or indemnity obligation
    • Actively monitor and evaluate handling of such claims by insureds within self-insured retentions or underlying carriers and gather all information, documentation and advice necessary to evaluate and manage the exposure to the insured and Gemini.
    • Participate in the defense of such claims with insureds or underlying carriers to the extent necessary to protect the interests of the insured and Gemini or assume control of the defense as may be required by policy language, law or circumstances.
    • Retain, lead and supervise monitoring counsel or defense counsel in representing the interests of the insured or Gemini or both.
    • Establish expense and loss reserves up to designated authority levels and recommend reserving above such levels to Claims Unit Manager, Senior Vice President of Claims and President of Gemini as needed.
    • Review, evaluate and, if necessary, respond in a reasonable and timely fashion to demands seeking payment of an insured's total applicable limits of liability, time-limited demands, offers of judgment, demands that Gemini settle a claim within its limits of liability and similar types of demands or offers.
    • Retain, lead and direct coverage counsel in providing advice and guidance to Gemini as needed.
    • Represent Gemini at settlement conferences, mediations and any court room or trial appearances as may be required.
    • Ensure that claims are being handled (by the insured, an underlying carrier or by Gemini) in a manner such that the insured and counsel retained to defend the insured are prepared and ready try a case to verdict if a reasonable negotiated resolution cannot be achieved.
    • Negotiation the settlement of claims on behalf of Gemini up to designated authority levels and request authority above such levels to Claims Unit Manager, Senior Vice President of Claims and President of Gemini as necessary.
  • Report on a regular basis to the Claims Unit Manager, Senior Vice President of Claims, Vice President of Underwriting, and President of Gemini due to nature of claims being handled.
  • Additional responsibilities and opportunities assigned based on need, performance and demonstrated development potential.
Qualifications

ย  ย Bachelor's Degree required ย  ย Juris doctor with litigation experience preferred. ย  ย Minimum of six (6) years handling or litigating commercial auto liability claims with an insurance company or law firm required. ย Experience handling trucking claims, in particular, preferred. ย  ย  ย Experience handling claims involving public transit systems (busses, subways, etc.) and railroads preferred. ย  ย Experience handling claims on behalf of umbrella or excess carriers preferred. ย  ย Must have excellent investigative and analytical abilities. ย  ย Must have excellent written and oral communications skills. ย  ย Creativity and problem-solving abilities are essential. ย  ย Ability to assess priorities and manage deadlines effectively. ย  ย Must have sufficient knowledge and confidence to lead, instruct, question and challenge, in a reasonable and appropriate fashion, counsel retained to represent insureds or Gemini or both. ย  ย Up to 20% travel.
