The Role
As Marketing Counsel, you will be an essential legal partner to OnePay's fast-growing marketing organization - turning ambitious, creative go-to-market ideas into launches that are compliant, ddefensible, and fast. This role will impact OnePay's vision by providing the legal foundation for a marketing function that is a sophisticated, high-velocity engine for growth and brand awareness.
You will be the go-to counsel across a wide range of subject matters, advising the business in real time while partnering with legal teammates to draft and negotiate the agreements that make marketing run. You will work closely with the Marketing, Brand and Design, Paid Media, and Product teams.
It is well-suited for a strategic legal operator who thrives in a fast-paced, collaborative environment and can navigate intensity, ambiguity, and imperfect processes with steady judgment.
This role is responsible for
  • Advising across the marketing lifecycle. Serve as the primary legal partner to marketing, brand, design, paid media, and product teams, providing practical, real-time counsel that keeps creative and campaigns moving.
  • Ad tech, privacy, and consumer data. Guide the responsible use of advertising technology, tracking, and consumer data - advising on the state privacy law patchwork (CCPA/CPRA and beyond), PII, targeting, and required disclosures across the ad stack.
  • Social media, creators, and influencers. Structure and paper creator, influencer, and brand-collaboration relationships, advising on FTC endorsement and disclosure rules, usage and content rights, and platform terms.
  • Rewards, sweepstakes, contests, and promotions. Design and review rewards programs, sweepstakes, contests, and promotions, including official rules, registration and bonding, and multi-state regulatory compliance.
  • Affiliate marketing. Advise on and paper affiliate and partner-marketing programs, including disclosures, tracking, and payout structures.
  • Production and content development. Support production and content development end to end - talent and releases, music and licensing, rights clearances, and production and vendor agreements.
  • Claim development. Partner with marketing and product on claim development - substantiation, puffery, comparative claims, and disclaimers - to keep messaging both compelling and defensible.
  • Scaling with AI and better systems. Bring hands-on fluency with AI tools to accelerate contract review, marketing review workflows, knowledge management, and issue-spotting, while maintaining appropriate controls and confidentiality. Build lightweight, stage-appropriate processes and self-serve guidance that let marketing move fast and stay compliant as volume and complexity grow.
  • Additional duties as assigned by your manager.

You bring
  • J.D. and active membership in good standing with a U.S. state bar.
  • 8+ years of legal experience, including at a leading law firm and/or in-house, with at least 6 years focused on marketing, advertising, and/or ad tech law.
  • Deep, hands-on command of the marketing-legal landscape: advertising and consumer-protection law (FTC Act, UDAAP), promotions and sweepstakes, endorsement and influencer rules, affiliate marketing, and advertising-related privacy (CCPA/CPRA, the state privacy patchwork, PII, and ad tech/tracking).
  • A demonstrated history of working directly with C-suite and other executive leadership - influencing decisions, earning trust, and communicating clearly at the highest levels.
  • Strong drafting and negotiation skills across agency, vendor, talent, and marketing-partnership agreements, with a strong eye for detail.
  • AI-forward: proficient with AI tooling and genuinely excited to use it thoughtfully to improve the team's velocity and quality.
  • An act-like-an-owner mentality. We have a bias toward taking action.
  • A practical, business-first mindset with the ability to weigh legal risk in the context of product, brand, and commercial realities, and to drive toward creative, business-oriented results in a fast-paced, high-pressure environment.
  • Clear, concise communication across creative, technical, and non-legal audiences, with the ability to influence decision-making at multiple levels.
  • Intellectually curious, comfortable with ambiguity and risk, and energized by dynamic change. Low ego, high ownership, and strong collaborative instincts - no task is too big or too small.

Preferred
  • Prior tech, fintech, or financial services experience, and familiarity with marketing in a regulated industry.
  • In-house experience at a high-growth consumer brand or platform.
