What is the difference between an attorney, lawyer, and litigator?

A litigation attorney is a lawyer who specializes in representing clients in court cases and legal disputes. What are some common challenges faced by litigation attorneys during the discovery phase of a case?

Litigation attorneys often encounter challenges in the discovery phase, such as managing large volumes of documents, navigating complex procedural rules, and responding to aggressive discovery requests from opposing counsel. Effective organization, attention to detail, and clear communication with clients and colleagues are essential to address these issues. Additionally, litigation attorneys must be adept at identifying relevant information while protecting privileged materials, all while working under tight deadlines.

As a litigator, your responsibilities and duties include investigating and developing your client's case. You walk clients through the process of filing their lawsuit, drafting all the necessary paperwork, and ensuring that you present the most persuasive case possible. You represent your client at pretrial hearings and at the trial itself if a settlement is not reached beforehand. You file all necessary motions and advocate for your client to the very best of your ability while upholding all ethical and legal standards.

Our annual billable expectation is 1800 hours, allowing attorneys to maintain a productive practice while continuing to invest in client relationships, professional development, business development, and other meaningful contributions to the firm.

Why You'll Love This Position

This position is 100% remote anywhere within Texas. No relocation is required. Instead of spending your time commuting, you'll focus on high-impact litigation while enjoying the flexibility that comes with practicing remotely.

Unlike many litigation practices, every case you handle has a direct impact on a client's professional future. You'll represent professionals whose licenses, careers, and reputations depend on the quality of your advocacy. As part of our boutique litigation practice, you'll receive meaningful responsibility, direct client interaction, substantial evidentiary hearing and courtroom experience, and opportunities to build long-term client relationships.

What You'll Do

You'll manage high-stakes litigation matters from initial investigation through resolution while working directly with clients and collaborating with experienced attorneys.

Responsibilities include:

  • Represent licensed professionals before Texas licensing boards and regulatory agencies.
  • Handle investigations, disciplinary proceedings, contested cases before the State Office of Administrative Hearings (SOAH), and related civil litigation.
  • Draft responses, pleadings, motions, discovery, legal briefs, and legal correspondence.
  • Participate in hearings, mediations, informal settlement conferences, negotiations, and litigation strategy sessions.
  • Advise clients throughout the litigation process.
  • Develop litigation strategy alongside experienced attorneys.

About Our Firm

Since 2003, BERTOLINO LLP has built a statewide reputation representing licensed professionals throughout Texas in high-stakes regulatory investigations, disciplinary proceedings, administrative litigation, and related civil litigation. Our mission is simple. We help professionals protect what they have worked so hard to build: their careers, livelihoods, and reputations. We represent physicians, nurses, pharmacists, dentists, veterinarians, educators, real estate professionals, and many other licensed professionals when government investigations, disciplinary actions, or civil disputes threaten their ability to practice.

Our attorneys combine more than 75 years of litigation and administrative law experience with strategic advocacy, sound judgment, and exceptional client service. As a boutique litigation firm, we offer attorneys meaningful responsibility, direct client relationships, challenging and rewarding cases, and the opportunity to make a real difference in clients' professional lives. We foster a collaborative, supportive culture where attorneys are trusted, encouraged to grow professionally, and provided a clear path toward long-term success.

What We're Looking For

We're seeking experienced litigators who exercise sound judgment, communicate effectively with clients, and can independently manage a litigation caseload.

Qualifications include:

  • Current licensed Texas attorney in good standing.
  • Four or more years of litigation experience with demonstrated ability to independently manage a litigation caseload and provide exceptional client service.
  • Excellent legal writing, research, analytical, and advocacy skills.
  • Strong client communication and case management abilities.
  • Professionalism, initiative, sound judgment, and a commitment to outstanding client service.

Attorneys with prior administrative law or regulatory experience are welcome to apply, but it is not required. Many of our attorneys have successfully transitioned from insurance defense, government practice, white-collar defense, commercial litigation, and other litigation-focused practices. We provide mentorship, training, and collaboration to help experienced litigators become successful in this unique and growing area of law.

If you're looking for more than just another litigation position and want to build a rewarding long-term career helping professionals protect what they have worked so hard to build, we'd welcome the opportunity to speak with you.
