Technology & Intellectual Property Litigation Associate Attorney

Locations: New York, NY | Seattle, WA | Washington, DC
Salary: $225,000–$330,000

Direct Counsel is seeking a Technology & Intellectual Property Litigation Associate Attorney to join a leading Am Law firm's Intellectual Property Litigation practice. This opportunity is ideal for a mid-to-senior-level associate with 3–7 years of experience handling sophisticated intellectual property litigation, particularly patent disputes involving complex technologies.

The successful candidate will work closely with experienced IP litigators on high-stakes disputes in federal courts, before the U.S. International Trade Commission (ITC), and in Patent Trial and Appeal Board (PTAB) proceedings. The practice represents market-leading technology companies and startups across industries including semiconductors, telecommunications, medical devices, software, fintech, and biotechnology.

Responsibilities
  • Represent clients in complex intellectual property disputes in federal district courts, before the ITC, and in PTAB proceedings.

  • Work closely with partners and senior attorneys to develop and execute litigation strategy.

  • Conduct legal research and analyze case law involving patent validity, infringement, and other intellectual property issues.

  • Handle matters involving the intersection of intellectual property and antitrust law.

  • Advise on high-technology aspects of commercial litigation and other complex disputes.

  • Draft pleadings, motions, discovery plans, briefs, and other litigation documents.

  • Prepare for and participate in depositions, hearings, and trials.

  • Review and analyze evidence and assist in developing trial strategies and materials.

  • Prepare trial materials and work with expert witnesses.

  • Monitor emerging legal and technological developments affecting intellectual property law, including technology standards and patent misuse defenses.

  • Assist with appeals and amicus briefs before the Federal Circuit and U.S. Supreme Court.

  • Manage multiple matters and competing deadlines in a fast-paced litigation practice.

  • Collaborate with partners, associates, clients, experts, and other litigation professionals.

Qualifications
  • J.D. from an ABA-accredited law school with an excellent undergraduate and law school academic record.

  • 3–7 years of intellectual property litigation experience.

  • Experience with patent litigation in federal courts, ITC proceedings, and/or PTAB proceedings.

  • Strong understanding of technical subject matter, particularly semiconductors, software, telecommunications, medical devices, fintech, biotechnology, or related technologies.

  • A degree in the sciences or a technical background is required.

  • Excellent legal research, writing, analytical, and problem-solving skills.

  • Strong oral communication and interpersonal abilities.

  • Ability to collaborate effectively in a team-oriented environment.

  • Ability to manage multiple complex cases and deadlines in a fast-paced practice.

  • Active bar admission or eligibility for admission in the jurisdiction where the attorney will practice.
