OVERVIEW:

The position of Attorney – Bankruptcy (Attorney) at Padgett Law Group a/k/a Timothy D. Padgett, P.A. provides support to the firm’s bankruptcy staff and clients. The Attorney reports directly and solely to the firm’s designated Supervising Attorney of Bankruptcy Operations. This position will carry a caseload.

The Attorney is responsible for ensuring compliance with all local, state and federal areas of concern relating to default servicing. These duties included attending hearings, management local appearance counsel hearings, reviewing documents, training staff, providing legal advice to clients, as well as conducting research at the local and federal level.

Employment reviews occur annually in accordance with the firm’s executive teams established performance review and will serve to determine merit-based increases based upon the revenue growth of PLG.


SCOPE OF WORK:

· Hearing Maintenance

o Attending hearings

o Managing Local Appearance Counsel hearing attendance by ensuring both the Attorney and Local Appearance Counsel are prepared prior to the hearing with clear instructions regarding the desired outcome

o Ensuring coverage for all scheduled hearings

o Providing immediate/real time hearing results internally and to the client

· Portfolio Management

o Ensuring internal and external systems of record are updated timely – i.e. within any established court deadline, client SLA, or internal deadline

o Ensuring staff have updated drafting templates that are in compliance with local and federal rules of procedure, as well as any district or judge specific rules

o Performing Quality Control reviews of documents prior to client and/or court submission to ensure compliance with all internal and external rules

o Monitoring dockets in which an appearance has been filed to timely identify and escalate any actionable docket events

o Ensuring upstream processes as well as any downstream processes are in compliance with are within any established court deadline, client SLA, or internal deadline

· Provide Loan Level Support to Firm Staff

o Answering loan level legal questions

o Providing training tools and drafting templates

o Coordinating with leadership to identify areas in which process and staff can be improved

o Acting with integrity, energy, and commitment at all times

o Displaying and embodying firm culture

o Maintaining consistency and stability through work ethic, and personal conduct

o Timely escalate, manage and mitigate any firm risk related legal matters performed by the firm’s bankruptcy department

· Provide Loan Level Support to Firm Clients

o Answering questions and communicating generally in a timely manner

o Providing training tools

o Escalating process level questions/issues/concerns to internal leadership

· Research

o Use vendor and other Firm tools to conduct research

o Provide results of research and recommendations regarding training, as well as technology or process changes needed

Requirements:



Minimum Qualifications (Knowledge, Skills, and Abilities)?


An active bar admission for the state in which you were hired with a member in good standing status


Admission or ability to get admitted to all bankruptcy courts within the state in which you have an active bar membership


Experience representing creditors in bankruptcy proceedings in the jurisdiction in which you were hired or the willingness to obtain bankruptcy knowledge.


Ability to work with others in a congenial and team-oriented manner.


Exceptional organizational skills and the ability to multi-task and be adaptable to continual change.


Excellent verbal and written communication skills.
